Bišćević-Tokić: Federation intends to follow RS's footsteps and violate Constitutional Court decisions, this must be stopped

(Patria) - The FBiH Government has sent the Bill on Construction Land in FBiH to parliamentary procedure, which brutally violates the decisions of the BiH Constitutional Court regarding state property, warns SDA MP in the FBiH Parliament Jasmina Bišćević-Tokić.

"Given that the proposal of this legal solution is expected to be on the agenda of the House of Representatives of the FBiH Parliament tomorrow, I have submitted an amendment to delete the disputed Article 4 from the proposal.

This article provides for the possibility of registering land as the property of the municipality or city in whose territory it is located, which is in direct conflict with the decisions of the BiH Constitutional Court which established that entities cannot appropriate competencies to decide on ownership rights over state property and that they do not have the constitutional competence to regulate legal matters relating to state property.

I call on my colleagues in the House of Representatives to support the amendment that deletes this unconstitutional article of the Law, so that the Federation does not again follow in the footsteps of the entity of RS in attempts to usurp state property contrary to the decisions of the BiH Constitutional Court and the decision of the High Representative on the prohibition of disposal of state property, which has already been the case in this mandate.

The lack of reaction from certain presidents of ruling parties who recently invoked the decisions of the BiH Constitutional Court, but only when they justified their subservience to coalition partners from HDZ BiH, is concerning.

Also concerning is the silence of officials from the ruling coalition who, in the previous mandate, while in opposition, warned of the danger of such solutions, and now, after taking office, like the Mayor of Stari Grad Municipality Irfan Čengić, they do not mind the violation of the BiH Constitutional Court's decisions and the usurpation of state property.

I hope that there will be enough parliamentarians who are aware of the danger that threatens by adopting such a legal solution, and that they will accept the amendment I have submitted to the proposed law," Bišćević-Tokić stated in a post on her Facebook profile.
