Begić: The BiH Presidency is the property of the citizens, not co-ownership of ethnic groups

(Patria) - To counter ethnic undemocratic elements, insisted upon in Dayton and by the so-called international community, the BiH system is not by chance interspersed with "indications" of democracy, among which is the election of the BiH Presidency, whose members - despite all known shortcomings established by court rulings - are still directly elected by the citizens - with the obligation to upgrade through the European Convention and its protocols towards eliminating these shortcomings and implementing international democratic legal standards, stated Member of Parliament and Professor of Constitutional Law Zlatan Begić.

-The BiH Presidency is a state institution that should be reformed in accordance with the European Convention (as part of the Constitution and legal order of BiH) and the rulings of the European Court - which is a legal obligation, and through this reform - to become a democratic institution of all BiH citizens in its full capacity, who constitute a unified BiH political nation, which international law recognizes the right to be represented in the United Nations through its - one BiH state and one vote.

To be represented as one nation in the international-legal sense - in the United Nations - where nations are united through their states - on the principle of one nation - one state. The Dayton BiH Constitution does not recognize the BHS ethnic groups as three separate nations, but calls them "constituent peoples", while the European Court has determined that the principle of constitutionality is discriminatory, that it severely violates human rights, and as such must be redefined.

The BiH Presidency was never conceived as co-ownership of ethnic groups - nor is it according to the Constitution, according to the method of election (citizens elect it directly; Annex 7 should also be considered), nor according to other provisions of the Constitution that directly refer to international instruments and democratic standards - but as a counterweight (with the obligation of upgrading and democratization) to the overemphasized ethnic element and its derivatives that call into question the democratic character of the entire order (e.g., the institution of state legislative power - the Parliamentary Assembly of BiH is under full ethnic control of an undemocratic nature through the House of Peoples; the so-called entity voting should also be mentioned as a distinctly undemocratic mechanism that produces multiple inequalities of votes in this legislative body, etc.).

If someone were to disrupt this, otherwise insufficient and minimal balance between the already overemphasized ethnic/entity element - which has all the characteristics of apartheid, and the minimal civic, i.e., democratic (even if unfinished) which is an anchor for the survival of the state and which should be reformed towards democratization - and not further segregation and apartheid, the entire state and its institutions become co-ownership of three ethnic groups, and any hope for building a democratic society is lost. This also ends the country's European path, because one cannot go to Europe as an undemocratic apartheid creation, where pronounced inequality of votes, apartheid, and segregation prevail.

The BiH Presidency does not belong to ethnic groups, nor is it their "common institution", and this right under the Constitution does not belong to any ethnic group in BiH, but is a state institution that should be reformed towards democratization, which should be elected by and for which all citizens should be able to run according to the European Convention and its protocols (which are part of the BiH Constitution and BiH legal order by force of the Constitution and by the act of ratification) etc.

Therefore, do not be misled by nacio-politicians steeped in corruption and political immaturity of criminal great-state policies, nor by their followers from Sarajevo. Keep in mind that top experts, professors of Constitutional Law, etc., worked on these mechanisms of minimal democratic counterweights during the Dayton process, and that they fought for them under circumstances of enormous international pressure. Certainly not for them to be interpreted and distorted today by various political and other starlets and intellectual immaturity, but so that future generations have some kind of support for building democracy, a democratic society, democratic state institutions, and a democratic state.

Let us repeat once again, the BiH Presidency does not belong to ethnic groups, nor does the BiH state, but to all its citizens. The sooner we understand this, the easier it will be for everyone.
