Begić: Minister Bunoza is for an apartheid system, unequal vote value, and severe ethnic discrimination

(Patria) - There is no democracy without citizens and the rule of law, stated constitutional law professor and Member of the Parliament of Bosnia and Herzegovina Zlatan Begić (DF) today on platform X.

Begić wrote this in response to a post this morning, also on platform X, by the Minister of Justice of BiH Davor Bunoza (HDZ BiH), who commented on the structure and functioning of the Presidency of BiH, emphasizing "the importance of the constitutional principle of the constituent peoples".

Among other things, Bunoza stated that "the Constitutional Court of BiH has emphasized that the purpose of the constitutional provisions is for the Presidency of BiH to consist of representatives of all three constituent peoples," and added "that in order for someone to protect the interests of those to whom it applies, it is necessary for them to possess the legitimacy of those whose interests they represent."

Bunoza also added that in this context, "it is important to emphasize that in the latest judgment of the Grand Chamber of the European Court of Human Rights (S. K. v. Bosnia and Herzegovina), the applicant has effectively proven that 'citizens' are actually members of the constituent peoples."

If the members of the Presidency of Bosnia and Herzegovina were to protect exclusively the interests of the entities and of the “citizens of the entities,” the Presidency would consist of two members, one from each entity.

Begić emphasizes that Minister Bunoza thus proves that he is against democracy and the rule of law.

"He is for an apartheid system, unequal vote value, and severe ethnic discrimination in which the legal obligation to implement the European Convention and its protocols, the judgments of the European Court of Human Rights, and the further implementation of the state Constitution, which includes the European Convention with its protocols (which are also ratified international instruments in BiH), will continue to be blocked and ignored.

This minister is guided by his personal political views, not by legal arguments and the positive law in force (such as the Constitution, the European Convention, its protocols, etc., as well as the judgments of the European Court).

In doing so, he acts as the Minister of Justice, trying to conceal his very meager biography and complete lack of any relevant scientific and professional references from the field of Constitutional Law, into which he very bravely, very often, and very mistakenly meddles.

I know many lawyers who are very educated and are among the top legal professionals and intellectuals. However, as in any profession, there are also those who are none of the above. This one, unfortunately, belongs to the latter group.

For this (unfortunately!) lawyer, falsifying public documents (and those of Croatian institutions, which he swears by) was a legitimate legal action for the purpose of rigging tenders during his legal practice."

It is unclear how he even passed the checks of the competent institutions for appointment to the position of state minister, which also speaks volumes about those institutions in the "trojka" era. Therefore, one should not be surprised at the persistent attempts to falsify everything by this person - including regarding what constitutes the foundations of public law, but also the impressive ignorance in the field of Constitutional Law that the aforementioned often presents, and from which field he possesses no relevant scientific or professional references.

He, of course, has the right to his political stance as a citizen Bunoza, and the fact that this stance has nothing to do with legal expertise and science, and that as such he is the state Minister of Justice - that is a disgrace to those who elected him, as well as to those who elected those who elected him to this very responsible position, which nevertheless requires at least a minimum knowledge of the foundations of Constitutional and public law, as well as personal, professional, and - if possible - academic credibility," stated Begić.
