
(Patria) - Member of the Presidency of BiH Denis Bećirović submitted today to the Constitutional Court of BiH
a request for constitutional review of the Law on Amendment to the Law on Use of Flag, Coat of Arms and Anthem
in the Bosnian-Herzegovinian entity of RS.
In the explanation of the request submitted to the Constitutional Court of BiH, Bećirović precisely presented the constitutional and legal reasons and facts that should serve as a basis for making a decision on the unconstitutionality of the disputed Law.
"Therefore, we expect the Constitutional Court of BiH to establish that the Law on Amendment to the Law on Use of Flag, Coat of Arms and Anthem in the Bosnian-Herzegovinian entity of RS is unconstitutional, and to repeal it and put it out of legal force.
We recall that the Constitutional Court of BiH already in 2006 established the unconstitutionality of the Law on Use of Flag, Coat of Arms and Anthem of the Bosnian-Herzegovinian entity of RS. Any attempt to re-adopt and apply this law is contrary to that ruling and represents a serious
challenge to the rule of law in Bosnia and Herzegovina.
The adoption of the Law on Amendment to the Law on Use of Flag, Coat of Arms and Anthem is just one of the
measures that resulted from the anti-Dayton Declaration of the so-called All-Serbian Assembly and is part of continuous systemic destructive efforts to fully harmonize the legislation of the neighboring Republic of Serbia and the Bosnian-Herzegovinian entity of RS. Such anti-constitutional and anti-Dayton activity represents a gross attack on the fundamental provisions of the General Framework Agreement for Peace in Bosnia and Herzegovina. It is an extremely dangerous attempt to undermine the sovereignty and territorial integrity of Bosnia and Herzegovina, which seriously threatens peace and stability in the Western Balkans.
At the same time, such action is completely contrary to the fundamental principles on which the United Nations are based, about which the member of the Presidency of BiH Denis Bećirović argued clearly and convincingly at the sessions of the UN Security Council and the UN General Assembly.
