Bećirović: Decisions of the Court of BiH are binding – unlawful acts of the RSNA will produce no legal effects

(Patria) - Regarding the latest anti-Dayton and anti-constitutional activities of the authorities of the BiH entity RS, member of the BiH Presidency Denis Bećirović stated that "The anti-Dayton and unlawful acts, adopted in the National Assembly of the RS (RSNA) on 22 August 2025, once again prove that the removed president of the BiH entity RS, Milorad Dodik, and his closest associates are not abandoning the dangerous policy of destabilizing Bosnia and Herzegovina."

"They continue with irresponsible activities that threaten the peace, independence, sovereignty and territorial integrity of Bosnia and Herzegovina. Milorad Dodik is now a private individual, with a final verdict and long-term restrictive measures in his file. By following him in his desperate moves, which undoubtedly violate and otherwise fail to respect the final and enforceable decision of the Court of BiH, the leaders of entity institutions are directly violating the Criminal Code of BiH, which prescribes for such acts a prison sentence of up to five years, as well as a ban on working in public bodies," Bećirović emphasizes.

He stresses that "The unlawful acts of the RSNA represent a flagrant violation of the Constitution of BiH and the Dayton Peace Agreement. Such acts are legally null and void, politically destructive and deeply destabilizing. These are activities that constitute a serious criminal offense. Neither the Constitution of BiH nor any applicable law gives entities the right to challenge or annul decisions of state institutions, and especially not to review final court judgments through a referendum. Furthermore, the unlawful acts of the RSNA have no legal basis and produce no legal effects. They exclusively contribute to the destructive policy of undermining the rule of law and the continuation of the self-isolation of the BiH entity RS."

"The competent state authorities of Bosnia and Herzegovina, especially the Prosecutor's Office of BiH, are obliged, in accordance with their powers, to take all necessary measures to protect the constitutional order and prevent further attempts to undermine the state. Also, international actors in Bosnia and Herzegovina have a clearly prescribed mandate and are obliged to clearly and unequivocally condemn any act that challenges the fundamental provisions of the Dayton Peace Agreement, as well as to sanction all those who threaten the peace and stability of Bosnia and Herzegovina and the region," Bećirović states.

Bećirović concludes: "The removed president of the BiH entity RS and his closest associates are obviously under a great and dangerous illusion if they think that their anti-Dayton and anti-constitutional activities will be met with folded arms."
