(Patria) - The Constitutional Court of BiH, deciding on the request of BiH Presidency member Denis Bećirović and fourteen members of the House of Representatives of the Parliamentary Assembly of BiH, made a decision declaring the Conclusions regarding the Information on the decision of the Central Election Commission of BiH on the termination of the mandate of the President of Republika Srpska Milorad Dodik, adopted by the National Assembly of RS, unconstitutional and invalid.
On this occasion, the Cabinet of the BiH Presidency member informs the public of the following:
The decision of the Constitutional Court of BiH confirmed that entities have no jurisdiction to dispute and question final judgments of the Court of BiH, as well as acts of state institutions.
In the explanation of the Decision, the Constitutional Court of BiH clearly emphasized that, based on the principle of the rule of law and the principle of separation of powers, final and binding decisions of the institutions of Bosnia and Herzegovina must be implemented, not re-examined by lower authorities. Any refusal to implement these decisions constitutes a direct violation of the Constitution and laws of Bosnia and Herzegovina and has serious legal consequences. The authorities in the RS entity must be aware that any further questioning of the authority of the highest state institutions leads not only to new judicial processes but also to further destabilization of the state and endangerment of peace and security.
BiH Presidency member Denis Bećirović pointed out that this decision of the Constitutional Court of BiH sent a strong message: entities do not have the right to self-determination, nor are they allowed self-organization and territorial secession, which endanger the constitutional order and territorial integrity of the state of Bosnia and Herzegovina. The Constitutional Court of BiH, with its decision in case no. U-26/25, once again confirmed that independent judicial institutions act in accordance with the Constitution and laws of Bosnia and Herzegovina, and that the rule of law has the strength to oppose attempts to derogate the constitutional order by entity authorities in the RS entity.
Bećirović assessed that the decision of the Constitutional Court of BiH represents a great legal victory for the state of Bosnia and Herzegovina, and that it is an encouraging message for all citizens in our country that institutions have the strength to protect the constitutional order of Bosnia and Herzegovina.
BiH Presidency member Denis Bećirović stated that in the future, using all available legal means, he will continue to act concretely, responsibly, and decisively in order to protect the independence, sovereignty, territorial integrity of Bosnia and Herzegovina, as well as the constitutional order of our state.
