Bećirović: Destruction of the Constitutional Court of BiH must not be a topic of discussion

(Patria) - Regarding the latest anti-Dayton and anti-constitutional messages from the president of the BiH entity Milorad Dodik concerning foreign judges in the Constitutional Court of BiH, member of the Presidency of BiH Denis Bećirović stated the following:

"The president of the BiH entity RS, Milorad Dodik, must completely forget the idea of destroying the Constitutional Court of BiH. Everyone in Bosnia and Herzegovina and beyond is well aware of his publicly declared anti-Dayton goals and policies, as well as the substantive reasons why the Constitutional Court of BiH and the High Representative of the international community in Bosnia and Herzegovina bother him.

No politician who advocates for the state of Bosnia and Herzegovina must agree to Dodik's ultimatums regarding the Constitutional Court of BiH, as well as other essentially important issues for Bosnia and Herzegovina. The Constitutional Court of BiH must not even be a topic of discussion with political extremists who threaten peace and the constitutional order of Bosnia and Herzegovina.

The European path of Bosnia and Herzegovina does not exist for political extremists to destroy the European and Euro-Atlantic future of Bosnia and Herzegovina, but for our country to become a functional and democratic state where European standards and principles are respected.

The status, composition, and jurisdiction of the Constitutional Court of BiH are regulated by the Constitution of BiH. The Constitutional Court of BiH is established by Article VI of the Constitution of BiH as an independent guardian of the Constitution and as an institutional guarantor for the protection of human rights and fundamental freedoms established by the Constitution of BiH and the instruments of Annex I of the Constitution of BiH. The Constitutional Court of BiH is not part of the legislative or executive branch, but is positioned by the Constitution of BiH as a separate, independent authority.

Taking into account the important role that the Constitutional Court of BiH has in the Constitution of BiH, which imposes the obligation to ensure its independence, including full financial and administrative independence and autonomy, it is inadmissible for any politician to undermine the role of the Constitutional Court of BiH," Bećirović stated.
