
(Patria) - Delegates in the KS Assembly yesterday voted to dismiss the KS Government.
The government reconstruction followed the decision by coalition parties SDP, NiP, and Our Party (NS) to exclude the Party for BiH (SBiH) from the majority, which had two ministers.
The opposition in the KS Assembly argued that a minister cannot be dismissed based on the Law on the KS Government, as claimed by the coalition, but only based on the Constitution of Sarajevo Canton.
SBiH delegate in the KS Assembly Muamer Bandić told Hayat.ba that the Constitutional Court of FBiH should provide a final opinion on whether this provision of the Law on the KS Government was unconstitutional.
Ultimately, let's see the Prime Minister's stance, which he expressed as an individual act, but which has consequences for ministers in terms of depriving them of the right to hold ministerial positions in the Government. I would like us to have a clear stance from the Constitutional Court of FBiH so that we do not find ourselves in a similar situation in the future. It is an unusual act for someone to resign and then perhaps appear as a new mandatary in ten days. At the very least, it is an abuse of the legal institute that allows it, and this would generally produce legal uncertainty for the future – Bandić told us.
He expects there will be enough delegates who share this view to sign the request for initiating an appeal to the Constitutional Court of FBiH. According to Bandić, this should be done not because of the ministers from the Party for BiH, but for the legal system in KS.
To verify whether the procedure was carried out in accordance with the Constitution and rules of procedure – Bandić told us.
This party had two ministers in the KS Government: the Minister of Spatial Planning and Communal Affairs Almir Bečarević and the Minister of Finance Emir Dedović.
We asked Bandić how satisfied he was with their work, which, according to many, was not even evaluated, but was a political dismissal.
Minister Dedović did many good and positive things for the Canton. I appreciate his work positively. He did one key thing that I insisted on. Namely, I submitted an initiative to the KS Assembly to annul the public call for the conclusion of agreements on the execution of court rulings. This was an illegal act that placed the Law on Enforcement Procedure in the background, while giving greater legal force to a certain agreement between individuals with final court rulings and the KS Government. With his actions, the minister corrected a type of injustice towards these individuals and thus enabled around 13 million KM for the payment of court rulings according to the Law on Enforcement Procedure. As for Minister Bečarević, what is crucial for me is that the increase in prices for public services, water supply, and waste disposal is not allowed. These were the policies advocated by the Party for BiH. It is important that he concluded an agreement with the Development Bank that will allow a part of the land at the Regional Center for Waste Management and the Smiljevići landfill to be permanently closed.
