Due to violation of Election Law provisions on electoral units: Two HDZ parties in the FBiH Parliament have three mandates more than they are entitled to

(Patria) - The number of mandates for the House of Representatives of the Parliament of the Federation of BiH allocated to each electoral unit does not correspond to the number of voters registered in the Central Voter Register.

By comparing the number of mandates per electoral unit with the Central Voter Register used during the 2022 General Elections, clear discrepancies are visible, writes Istraga.ba.

A total of 73 direct and 25 compensatory mandates are allocated to the House of Representatives of the FBiH Parliament.

Looking at individual electoral units - Electoral Unit 1 (401) was allocated nine mandates in the previous parliamentary elections, Electoral Unit 2 (402) five mandates, Electoral Unit 3 (403) seven, Electoral Unit 4 (404) four, Electoral Unit 5 (405) eight, Electoral Unit 6 (406) four, Electoral Unit 7 (407) six, Electoral Unit 8 (408) nine, Electoral Unit 9 (409) eight, Electoral Unit 10 (410) three, Electoral Unit 11 (411) seven, and Electoral Unit 12 (412) three mandates.



Article 10.9 of the Election Law of BiH stipulates that the Parliament of the Federation of BiH reviews electoral units and the number of mandates every four years to ensure they are determined, taking into account geographical limitations, in accordance with democratic principles, and especially the proportionality between the number of mandates and the number of voters registered in the Central Voter Register.

The Parliament of the Federation of BiH has not carried out such adjustments, although the law allows it.

Discrepancies exist in electoral units 402, 404, 406, 407, 408, 409, and 412. If the number of allocated mandates had followed the status of the Central Voter Register as of July 5, 2021, used for the 2022 elections, Electoral Unit 2 (402) would have received one more mandate, so it would have been allocated 6 mandates instead of five.



Electoral Unit 4 (404) would also have received one more mandate, so it would have had 5 mandates instead of 4.

Electoral Unit 6 (406) would have lost one mandate. Instead of the 4 it currently has, it would have been allocated 3 mandates.

Electoral Unit 7 (407) would have received two more mandates, so it would have been allocated eight mandates instead of six.

Electoral Unit 8 (408) would have lost one mandate, as would Electoral Units 9 (409) and 12 (412).

Electoral Unit 8 (408) would have had eight mandates according to a realistic calculation, not nine as is currently the case, Electoral Unit 9 (409) seven mandates instead of eight, while Electoral Unit 12 (412) would have had two mandates instead of three.

If we were to recalculate the regular mandates based on the number of votes received by parties during the 2022 parliamentary elections, but in accordance with the number of mandates based on the Central Voter Register and the provisions of the Election Law, SDP would have received an additional mandate from Electoral Unit 2 (402), as would DF in Electoral Unit 4 (404).

In Electoral Unit 6 (406), SDA would have lost one mandate, while in Electoral Unit 7 (407) it would have gained one mandate, as would NiP.

In Electoral Units 8 (408) and 9 (409), HDZ would have lost one mandate each, a total of two. Finally, in Electoral Unit 12 (412), HDZ 1990 would have lost one mandate.

Looking at the regular mandates overall, SDP, DF, and NiP would each have gained an additional mandate, SDA would have remained at the same number, HDZ would have lost two, while HDZ 1990 would have lost one regular mandate.
