HVS will ask the BiH Prosecutor's Office for a statement on allegations that a war crimes indictment was halted

(Patria) - The High Judicial and Prosecutorial Council (HVS) will ask the Administration of the Prosecutor's Office of Bosnia and Herzegovina for a statement on the allegations of prosecutor Izet Odobašić that Milanko Kajganić, the chief state prosecutor, has prohibited the submission of an indictment for crimes in Sanski Most and Manjača to the State Court for confirmation, Detektor has confirmed.

Members of the Standing Commission for the Efficiency and Quality of Prosecutor's Offices of the HVS of BiH considered the material that prosecutor Odobašić submitted to this institution on January 23, 2026, “in the context of selecting cases for analytical evaluation,” against his former school professor and managers in the institution where he worked.

“The Standing Commission has tasked the Department for Judicial Analytics and Reporting of the HVS of BiH Secretariat to request a statement in writing from the Administration of the Prosecutor's Office of Bosnia and Herzegovina regarding the allegations of prosecutor Odobašić,” it was stated.

Detektor previously wrote that prosecutor Odobašić sent information to the Standing Commission for the Efficiency and Quality of Prosecutor's Offices at the HVS stating that the chief state prosecutor Kajganić prohibited the submission to the BiH Court for confirmation of an indictment for crimes in Sanski Most and Manjača, filed against his former teacher from the police high school and professor at the police academy, and other individuals. The information stated that Kajganić did everything to prevent the indictment against suspect Mile Došenović from being filed. Odobašić also filed a complaint against Kajganić with the Office of the Disciplinary Prosecutor.

Following this, Kajganić also filed a report with the ODP against prosecutor Odobašić for the disciplinary offense of failing to follow the instructions of the superior prosecutor and violating the principles of the Code of Ethics for Prosecutors.

Prosecutor Odobašić told Detektor that his boss Kajganić should have recused himself from the case against Mile Došenović for war crimes in Sanski Most and Manjača because he knew the suspect, and that it was a conflict of interest.

The BiH Prosecutor's Office stated that Došenović was a professor at an educational institution “which, along with hundreds of other students, was also attended by Chief Prosecutor Kajganić” 33 years ago. They also added that Došenović was one of the managers in the institution where Kajganić worked 22 years ago. The Prosecutor's Office's response does not specify which educational institution Došenović was a professor at, nor which institution he managed.

“Chief Prosecutor Kajganić is not, nor has he ever been, the acting prosecutor in the mentioned case, and recusal was not requested because, according to the views of the BiH Court, the mentioned are not grounds for recusal,” Detektor was told.
