Constitutional Court of RS accepted the request of the Bosniak Caucus, decision on referendum within a month

(Patria) - The Constitutional Court of RS will make a substantive decision within the next month regarding the request of the Bosniak Caucus in the National Assembly of RS concerning the violation of vital national interest by the decision to call a referendum, reports Anadolu Agency.

The subject of the decision of the Council for the Protection of Vital National Interest of the Constitutional Court of RS concerned the admissibility of the requests of the Caucus of Delegates of the Bosniak People in the National Assembly of RS for the determination of the violation of the vital national interest of the constituent Bosniak people in relation to the Law on Amendments to the Law on Referendum and Civic Initiative and the Decision on the Early Entry into Force of the Law, as well as in relation to the Decision on Calling a Referendum and the Decision on Early Entry into Force.

These acts were adopted by the National Assembly of RS by the votes of the parliamentary majority at the 24th special session held on August 22.

"The Council determined today that the requests are admissible, given that the procedure related to vital national interest has been carried out in accordance with Amendment LXXXII to the Constitution of RS, which amended Article 70 of the Constitution. Furthermore, the Council also stated that other procedural prerequisites for a substantive decision on these requests have been met, and substantive decisions will be made within the constitutionally prescribed period of the next month," stated the Constitutional Court of RS.

The contested law stipulates that a referendum in RS can be conducted by the National Assembly of RS, i.e., an ad hoc committee, and the decision stipulates that the referendum be held on October 25 with the referendum question: "Do you accept the decisions of the unelected foreigner Christian Schmidt and the verdicts of the unconstitutional Court of BiH issued against the President of RS, as well as the decision of the Central Election Commission on revoking the mandate of the President of RS Milorad Dodik?".

The law and the decision were adopted at a special session of the National Assembly of RS following the decision of the Central Election Commission of BiH on revoking the mandate of Milorad Dodik as the President of RS.

The Central Election Commission of Bosnia and Herzegovina called early elections for the president of the BiH entity of RS for November 23, 2025. The conditions for calling the elections were met after a final verdict by the Court of BiH, which sentenced the President of RS to one year in prison and a ban from holding the office of president for six years.

The CEC of BiH then revoked Dodik's mandate on August 6 of this year, and the decision of the election commission was also confirmed by the Appellate Panel of the Court of BiH.

In addition to the USA, the United Kingdom, Germany, Austria, Poland, and Lithuania have already imposed entry bans and asset freezes against Dodik, his family, and several other high-ranking officials of RS.
