Constitutional Court of BiH annuls conclusions of the RS National Assembly on Milorad Dodik's mandate

(Patria) - The President of the Constitutional Court of BiH, Mirsad Ćeman, today issued a decision adopting the request for a provisional measure in case number U-28/25.

In this case, the petitioners (fourteen members of the House of Representatives of the Parliamentary Assembly of BiH) submitted a request for a constitutionality review seeking resolution of a dispute between BiH and the RS entity concerning the Conclusions of the RS National Assembly regarding the Information related to the decision of the Central Election Commission (CEC) of BiH on the termination of the mandate of the President of RS, Milorad Dodik, which the RSNA adopted at its 24th special session held on August 22.

They also requested that the Constitutional Court issue a provisional measure.



By the decision on the provisional measure, the Constitutional Court temporarily annulled points 6, 7, and 8 of the Conclusions of the National Assembly of RS regarding the Information related to the decision of the CEC of BiH on the termination of the mandate of the President of RS, Milorad Dodik, which the RSNA adopted at its 24th special session held on August 22, 2025.

The Constitutional Court also decided that, until its final decision on the submitted request for a constitutionality review of the acts, all acts adopted based on points 6, 7, and 8 of the Conclusions are temporarily annulled, and that all legislative, executive, and judicial institutions in the RS, as well as all official or responsible persons in those institutions of the RS or local self-government units or any body of a local self-government unit, as well as official or responsible persons from the RS holding office in BiH institutions, are temporarily prohibited from taking any actions based on points 6, 7, and 8 of the Conclusions.



This decision enters into force immediately and produces legal effect from the date of entry into force of the Conclusions regarding the Information related to the decision of the CEC of BiH on the termination of the mandate of the President of RS, Milorad Dodik, until the final decision of the Constitutional Court of BiH on the submitted request for a constitutionality review.

The Constitutional Court reminds that the decision on the provisional measure in no way prejudges the decision on the admissibility or merits of the submitted request.
