Constitutional Court of Bosnia and Herzegovina will not discuss the merits of unconstitutional laws of the RS National Assembly at the end of March

(Patria) - The plenary session of the Constitutional Court of Bosnia and Herzegovina is scheduled for March 27 and 28, 2025, but according to the published agenda, the Constitutional Court will not discuss the merits of the laws adopted by the National Assembly of the RS.

We remind you that the Constitutional Court of Bosnia and Herzegovina issued a provisional measure suspending the unconstitutional laws adopted by the National Assembly of the Republika Srpska.

This is effectively a temporary suspension of the laws on the Court, Prosecutor's Office, HJPC, and SIPA, which have already been published in the Official Gazette of the RS.

The Constitutional Court of BiH held an extraordinary session at the request of BiH Presidency member Denis Bećirović, Speaker of the BiH House of Representatives Denis Zvizdić, and delegate in the BiH House of Peoples Kemal Ademović, and the laws adopted in the National Assembly of the RS are suspended until the final decision of the Constitutional Court of BiH on this matter.

The Constitutional Court of BiH will make a final decision on the constitutionality of these laws in the coming period, and the provisional measure is aimed at preventing damage to the constitutional order of BiH.

The Constitutional Court explained that the decision was made with the aim of preventing further harmful consequences and preserving legal certainty and protecting the functioning of BiH institutions until a final decision is reached.

– The Constitutional Court therefore considers that there is urgency in adopting a provisional measure to prevent further harmful consequences and preserve legal certainty, and to protect the functioning of the institutions of Bosnia and Herzegovina until a final decision on the merits of the request is made – was previously stated in the explanation of the Constitutional Court of BiH.

Even after the decision of the Constitutional Court of BiH, Dodik announced that the RS would continue to apply its laws regardless of the decision of the Constitutional Court, which he called truncated and incapable of making decisions as such.
