BiH Prosecutor's Office Halts All Activities in RS While Dodik Carries Out a Coup: What Are Kajganić and 58 Prosecutors Doing?

Since February 27, Milorad Dodik and his ruling coalition have been carrying out a coup through the National Assembly of RS. The adoption of unconstitutional laws prohibiting the work of state judicial institutions (Court of BiH, Prosecutor's Office of BiH, HJPC) and the State Investigation and Protection Agency (SIPA) on the territory of RS, the voting on the draft of a new Constitution of RS which makes the BiH entity independent from the state of BiH, the formation of an entity intelligence service, confrontations with the opposition that have moved from verbal insults to serious criminal offenses, attacking both property and life, threats of conflict and resistance by armed members of the RS MoI to anyone who attempts to deprive the organizers and perpetrators of the coup of their freedom, have been observed for days by the Prosecutor's Office of Bosnia and Herzegovina.

The only judicial institution that can and must act on every inch of BiH and apply the law equally to every citizen of BiH, regardless of who they are or what position they hold, has been silently observing the collapse of the state and the institution where 58 state prosecutors, led by Milanko Kajganić, receive high salaries for days.

The unconstitutional laws passed by the NSRS came into effect on March 5, and their implementation began on March 6. Already on March 7, SIPA employees were forced to leave their workplaces in Banja Luka. To this day, we have not clearly heard Director Darko Ćulum utter the sentence: I ordered them to leave the building!

Those who had the opportunity to ask him about it in various commissions and (un)independent bodies, for some twisted and incomprehensible reason, stood up in his defense. Both those from the authorities in FBiH, and those from the opposition from RS. Ćulum was at a meeting on March 2 with other leading officials of Serb nationality in police structures with the President of RS Milorad Dodik and Željka Cvijanović, as well as the leadership of the RS MoI. Even their family members do not believe the false justifications of the meeting participants that they were unaware of Dodik's presence. Dodik had announced the meeting with police structures publicly at a press conference the day before, saying: "This is a regular meeting of police structures, only Željka and I will be there."

Ćulum remained unscathed. He was not sanctioned for the meeting with Dodik on March 2, nor for preventing SIPA's work in Banja Luka on March 7, nor for halting all activities in the RS due to "security risks," nor for agreeing to act on the order of the BiH Prosecutor's Office to provide assistance in bringing suspects Milorad Dodik, Nenad Stevandić, and Radovan Višković for questioning. Ćulum remained unscathed in 2023 as well, when he participated in a meeting at the invitation of Staša Košarac regarding the possible withdrawal of personnel from institutions due to Dodik's court proceedings.

Yesterday, these police officers were a bit smarter and did not come to Banja Luka again, but Dodik noted that those who did not come, but hold important positions, remain loyal to the interests of Republika Srpska.

The BiH Prosecutor's Office and the infamous prosecutorial team dealing with the attack on the constitutional order have made only one statement since December 2024, on March 6:

“The Prosecutor's Office of BiH is working and operating at full capacity. Regarding current events, we inform you that the Prosecutor's Office of BiH has been conducting investigative actions since December 2024, due to the existence of grounds for suspicion that a criminal offense – Attack on the Constitutional Order from Article 156 of the Criminal Code of BiH has been committed,” the statement said.

And after the second week of the coup is passing, EUFOR forces are strengthening, and the instigators of the attack on the constitutional order are not stopping in their intentions to form the RS state, the situation in the Prosecutor's Office of BiH is as follows: ALL ACTIVITIES IN RS ARE HALTED!

Investigators are not going to the field, war crimes cases, especially genocide crimes, are stopped. The justification given is the “security situation,” and in practice, this means that the BiH Prosecutor's Office is applying Dodik's unconstitutional laws.

And that means that the Prosecutor's Office does not respect the decisions of the Constitutional Court of BiH, which declared them invalid, nor has anyone been prosecuted so far for not respecting the decisions of the Constitutional Court of BiH, even though reports are regularly submitted to the Prosecutor's Office regarding decisions that have not been implemented.

The Prosecutor's Office has never prosecuted anyone for denying genocide crimes, but indictments have been regularly filed against those who defended the state of BiH, where these same prosecutors, no matter where they come from, can freely do their job. These heroes of defense against the aggressor are now in the dock, their indictments are being written in Belgrade and in Ekavian dialect, while those who would destroy the state for their own gain are not.

Perhaps the informal "Sarajevo son-in-law" should put his finger on his forehead and ask himself if he is up to the task of Chief Prosecutor in these moments. He was chosen as a prosecutor without a single indictment, with work experience from the RS MoI and as an investigator in the Special Prosecutor's Office in Banja Luka, and then as Chief Prosecutor, where he mysteriously remained the only candidate in the race.

Today, Kajganić, his deputies, and all prosecutors of the BiH Prosecutor's Office are being tested, and it is the most important one.

Are they loyal to the state, the BiH Constitution, and the laws of this state, or to those who once installed them in the BiH judiciary for other purposes?
