Court of BiH declares itself incompetent in the case against Debevec and Mehmedagić

(Patria) - The Court of BiH has declared itself incompetent in the case against the suspended president of that court, Ranko Debevec, and the former director of the Intelligence-Security Agency (OSA) of BiH, Osman Mehmedagić, information that has unofficially "leaked" from that institution.

The decision by which the Court declared itself incompetent was made by pre-trial judge Dalida Burzić, who stated that the Court of BiH cannot rule on the case against the president of that judicial institution.

According to this decision, the indictment, along with all collected evidence, should be forwarded to the Special Department for Combating Corruption and Organized Crime within the Federal Prosecutor's Office (POSKOK).

The Prosecutor's Office of BiH, which filed the indictment in this case, has the right to appeal this decision of the Court of BiH.

Tatjana Vasić, the lawyer of Ranko Debevec, told Faktor that the defense teams of the suspects have not received this court decision.

- The same story is constantly repeated, and the rights of the suspects to a fair defense are being violated in the most brutal way again. For the umpteenth time, we are learning information about the case we are working on from the media - says Vasić.

It is worth mentioning that the Constitutional Court of Bosnia and Herzegovina, ruling on Ranko Debevec's appeal regarding the detention order, concluded that his right to an impartial court, as an aspect of the right to personal liberty and security, had been violated.

The Constitutional Court stated at the time that "the appellant's fear of bias from the judge who ruled on the detention order could be considered objectively justified".

Let us recall, on July 1, the Court of BiH received the indictment from the Prosecutor's Office of BiH against the suspects Ranko Debevec, Osman Mehmedagić, and Milisav Pijuk, an employee of the Court of BiH.

They are accused of committing criminal offenses through the actions described in the indictment:

• Ranko Debevec - abuse of position or authority, forgery of an official document, accepting a reward or other benefit for trading in influence, accepting a reward or other benefit for trading in influence, unauthorized wiretapping and audio or visual recording, and the criminal offense from Article 29 of the Law on Gender Equality of BiH and misrepresentation;

• Osman Mehmedagić - abuse of position or authority, forgery of an official document;

• Milisav Pijuk - unauthorized wiretapping and audio or visual recording, and the criminal offense from Article 29 of the Law on Gender Equality of BiH and misrepresentation.
