
(Patria) - For the interest of the public and previously submitted inquiries, we inform you that the Court of BiH received the decision of the Constitutional Court of BiH in the case of Fadil Novalić and others on 28.11.2024.
In this regard, the Court immediately proceeded with the urgent action of releasing the accused Fikret Hodžić, given that, according to the provisions of the Law on Execution of Criminal Sanctions, Detention and Other Measures of BiH and Article 5 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, and after the appellate panel's verdict of 2.11.2023 was overturned in relation to him, he can no longer be serving a prison sentence.
"Namely, after the decision of the Constitutional Court of BiH, the causal link between the existence of a final verdict and deprivation of liberty was lost, which is why he must be released immediately, in accordance with Article 5 of the European Convention on Human Rights and Fundamental Freedoms.
The public will be informed in a timely manner about further procedural actions, i.e., the appellate panel session that will be scheduled for the purpose of re-examining the appeals of the accused Fikret Hodžić and the legal entity 'F.H. Srebrena malina', in the part as specified by the decision of the Constitutional Court of BiH", announced the Court of BiH.
