SDP TUZLA: The dismissed government is introducing a dictatorship in the Tuzla Canton

At yesterday's lawful and legal session of the TK Assembly, the majority of 18 deputies finally unblocked the Tuzla Canton and freed citizens from a corrupt, incompetent and unconstitutionally formed government which, having lost the support of the assembly majority, lost its legitimacy to make decisions, it was announced from the SDP Tuzla Cantonal Committee.

"Shortly thereafter, from the officials of the dismissed government (SDA, SD and DF) came a salvo of unfounded, illegal and above all dangerous reactions that contribute to the destabilization of the Tuzla Canton, deepening the crisis that they themselves produced, and spreading fear among citizens. It is dangerous and unserious that the dismissed government does not treat the legally elected deputies who form the new assembly majority as such, but accuses them of attacking the constitutional order. The dismissed Vujović and Tulumović, as well as their legal mentors, should know at least the basics of law, and that an attack on the constitutional order is treated as the use of 'PHYSICAL FORCE' by which an attempt is made to change the constitutional order and overthrow government institutions. Therefore, an attack on the constitutional order exists only when the overthrow is violent. The dismissed government must know that the deputies of the majority are not some informal group, but 18 legitimately and legally elected representatives who peacefully and lawfully convened a session and, by a majority of votes, made decisions on the dismissal of the leadership of the Assembly and the Government of the TK."

We inform the public that the aforementioned invocation of criminal code provisions that treat an attack on the constitutional order is only a prelude to what the dismissed government wants as a last resort, and that is 'dictatorship and the creation of a state of legal chaos'. Thus, despite the fact that the entire current government was legally and democratically dismissed, it hastily convened yesterday and passed a conclusion on the declaration of 'extraordinary circumstances' by which the Government of the TK took over the competencies of the Assembly. We warn that the constitution of the Tuzla Canton stipulates that the Government of the TK, only in extraordinary circumstances during the duration of danger to the country and the Canton, when there is an objective impossibility to convene the Assembly of the Tuzla Canton, is authorized to pass regulations within the jurisdiction of the Assembly of the TK. In the Tuzla Canton, there is no situation where anyone has declared extraordinary circumstances, war, immediate danger, natural disaster, and the Assembly can meet without any problems. The Government of the TK cannot declare extraordinary circumstances by conclusion, especially not based on the request of the already dismissed President of the TK Assembly. If there is war or immediate danger or an attack on the constitutional order, then the bodies of Bosnia and Herzegovina are there, it was announced.

They further point out that Prime Minister Tulumović and the Government of the TK made this conclusion without verifying the factual situation, based on the letter from the dismissed President of the TK Assembly, Žarko Vujović.

"By signing the conclusion, Prime Minister Tulumović committed a criminal offense under Article 383 of the Criminal Code of the FBiH because he exceeded the limits of his official authority, in order to obtain benefits for himself, the members of the dismissed Government, as well as the dismissed President and Vice-President of the TK Assembly, in the form of illegally remaining in office and receiving benefits that do not belong to them by law. With yesterday's illegal actions by the legally dismissed government, the beginning of a dictatorship in the Tuzla Canton has been formalized, against which we will continue to fight with all legal means and by filing lawsuits with the competent authorities," it is added.
