SDP Stronger Than The Law of the Game with the FBiH Tax Administration: Government Annulled the Competition Despite Another Successful Candidate for Director!

(Patria) - The last day of 2025 was a working day for the FBiH Government. Several decisions were made at the 272nd emergency session, and three decisions concern the Tax Administration of the Federation of BiH.

After Muhamed Hasanović refused to take over the position of Director of the Tax Administration of the Federation of BiH and decided to remain in the position of Deputy Minister of Finance and Treasury, the FBiH Government decided to annul the competition from 2024 and made a decision to announce a new competition.

At the same session, the Government made a decision of authorization by which Admir Omerbašić, head of the Cantonal Tax Office Tuzla - Assistant Director, is authorized to organize all tasks within the scope of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina and to sign all acts within the scope of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina, until the appointment of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina. Omerbašić was also authorized to manage the Tax Administration of the FBiH since August 2024. In December 2025, the FBiH Government appointed Slobodan Vukoja as Deputy Director for a new term.

What is interesting in the whole story is that on the list of successful candidates of the Civil Service Agency of the FBiH was also Jasmina Hurić-Bjelan, a long-time employee of the Tax Administration of the FBiH and head of a sector. When Hasanović refused the position, the FBiH Minister of Finance Toni Kraljević did not propose another successful candidate, but the Government decided to annul the competition.

No one is hiding anymore that the position of director belongs to the SDP, so the law has taken a back seat. Thus, on December 31, the FBiH Government made a decision to announce a Public Competition for the selection and appointment of the Director of the Tax Administration of the FBiH.

“A Public Competition for the selection and appointment of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina is announced.

The public competition from point I. of this decision will be conducted in accordance with the Law on Civil Service in the Federation of Bosnia and Herzegovina ("Official Gazette of the Federation of BiH", no. 29/03, 23/04, 39/04, 54/04, 67/05, 8/06, 77/06, 4/12, 99/15 and 9/17 - Constitutional Court ruling of the Federation of Bosnia and Herzegovina number U-13/16) and the Law on the Tax Administration of the Federation of Bosnia and Herzegovina ("Official Gazette of the Federation of BiH", no. 33/02, 28/04, 57/09, 40/10, 27/12, 7/13, 71/14, 91/15 and 44/22).

After the Public Competition from point I. of this decision is completed, the Federal Minister of Finance will propose a candidate to the Government of the Federation of Bosnia and Herzegovina for the appointment of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina.
The Federal Ministry of Finance and the Civil Service Agency of the FBiH are tasked with implementing this decision, each within their jurisdiction.

Upon the entry into force of this decision, the Decision on announcing the Public Competition for the selection and appointment of the Director of the Tax Administration of the Federation of Bosnia and Herzegovina ("Official Gazette of the Federation of BiH", number 43/24) shall cease to be valid”, the announcement in the Official Gazette of the FBiH of December 31 states.

Whether Omerbašić will be the new director of the Tax Administration of the FBiH will obviously be decided by the bodies or certain factions within the SDP, not by the competition procedure.

It should not be forgotten that the director of the Civil Service Agency of the FBiH is already involved in the "Spengavanje" affair. Whether POSKOK will have work in this case as well will be seen very soon.
