Someone Must Initiate Disciplinary Proceedings Against Zubac and Lukač

Serious investigations against Goran Zubac, Director of the Agency for Investigations and Protection, and Dragan Lukač, Director of the FUP, have confused the public in Bosnia and Herzegovina. Many expected a reaction from the Independent Board of the Parliamentary Assembly of BiH or the Council of Ministers of BiH demanding their suspension. However, this did not happen. Sanel Nezirić, a well-known Sarajevo lawyer, told the Patria News Agency that according to the Law on Police Officers of BiH, it remains very unclear what happens to the heads of police bodies in such cases.

- Specifically, at the state level, there is also the Police Officer Appeals Committee, and there are Disciplinary Commissions. Now, Zubac would have to form a Disciplinary Commission if disciplinary proceedings were to be initiated against him. To form a Disciplinary Commission that would determine if he is disciplinarily responsible, which is completely absurd – Nezirić said.

He further noted that an indictment needs to be filed for the Independent Board to decide on the potential dismissal of Goran Zubac.

- If an indictment were filed, he would no longer be suitable for that position, because the condition for being appointed to this position is that there is no indictment against him, except for traffic safety offenses – Nezirić added.

Emphasizing that the law is quite vague in this case, Nezirić underlines that the Independent Board, and possibly the Council of Ministers of BiH, could initiate the procedure for dismissing the director if they assess that, due to these investigations, they are not adequate for performing such important functions.

- Especially in Zubac's case, if he is accused of endangering the constitutional order of BiH and refusing to cooperate with the Directorate for the Coordination of Police Bodies, because if a director refuses such cooperation, and is legally obliged to do so, then he should undoubtedly be dismissed. This suspicion of war crimes also carries weight because SIPA is the most important instrument in war crimes investigations – Nezirić added.
