
(Patria) - The Special Department for Corruption, Organized and Inter-Cantonal Crime of the Supreme Court of FBiH confirmed the indictment of the Special Department of the Federal Prosecutor's Office of FBiH (POSKOK), filed against several natural persons and one legal entity for the criminal offense of abuse of office or authority. and in public institutions and legal entities, and security measures were proposed against the accused legal entity.
The indictment includes: Denijal Tulumović, former acting director of the Public Health Institution University Clinical Center Tuzla; Marko Tadić, founder and owner of the company INEL-MED d.o.o. Mostar; Šefik Husić, assistant director of PHI UKC Tuzla for nursing, Senada Hujdurović, director of the Private Health Institution General and Special Hospital "Plava Medical Group" Tuzla; Private Health Institution General and Special Hospital "Plava Medical Group" Tuzla, as a legal entity.
The accused Denijal Tulumović, Marko Tadić, and Šefik Husić are charged with, in the period from 2022 to 2025, abusing official authority and acting in collusion, unlawfully influencing public procurement procedures for medical equipment of high financial value, namely the procurement of a linear accelerator and related equipment for the needs of the public health institution, with an estimated value of 8,547,008.55 KM excluding VAT, with the aim of favoring the bidder INEL-MED d.o.o. Mostar and restricting competition.
It is also stated that due to such actions, the public procurement procedures were repeatedly canceled after appeals filed by another bidder, which led to a multi-year delay in the procurement of necessary medical equipment. Because of this, PHI UKC Tuzla was unable to ensure the continuity of radiotherapy treatment in a timely manner, as a result of which cancer patients were referred for treatment to other health institutions in Bosnia and Herzegovina and abroad, with an extended waiting time for radiotherapy, thereby increasing the health risk and endangering the lives of patients, as well as additional financial and psychosocial consequences for patients and their families.
Furthermore, the indictment charges Denijal Tulumović and Senada Hujdurović with concluding a business cooperation agreement between PHI UKC Tuzla and a private health institution in January 2023, contrary to applicable regulations, thereby illegally obtaining property benefits for the Private Health Institution General and Special Hospital "Plava Medical Group" Tuzla in the amount of over 128,000 KM, while at the same time causing property damage to the University Clinical Center Tuzla.
The indictment proposes the examination of 84 witnesses, 5 experts, and the presentation of over 500 material evidence for the main trial.
It was also proposed to confiscate illicitly gained property and award damages to the injured party PHI UKC Tuzla, to confiscate items and impose security measures on the accused, namely a ban on performing jobs and functions in public institutions and legal entities, and security measures were proposed against the accused legal entity.
