
(Patria) - The Trade Union of Employees of the Federal Ministry of Internal Affairs (FMUP) today, through their lawyer, and on behalf of police officers, civil servants and employees of the Federal Police Administration (FUP) and FMUP, filed a criminal complaint with the Sarajevo Canton Prosecutor's Office against the Prime Minister of the Federation of Bosnia and Herzegovina, Fadil Novalić, and five other individuals - directors of commercial banks in the Federation of Bosnia and Herzegovina.
As the Trade Union stated in a press release, the aforementioned criminal complaint was filed "for the criminal offense of non-execution of a court decision (Article 351 of the Criminal Code of the Federation of BiH)", in relation to the suspension of payments based on final and enforceable judgments.
"The complaint was filed due to obstruction and unequal treatment in the execution of judgments in labor disputes, related to unpaid overtime hours, night work, salary reductions..., which has resulted in a serious violation of the rights of members and employees whose interests and rights are protected by the Trade Union, as well as damage to the budget of the Federation of BiH in the form of default interest, for which the Prime Minister of the Federation of BiH bears the greatest responsibility.
Given that all elements of the criminal offense of non-execution of a court decision, which is prosecuted ex officio and is classified as a criminal offense against the judiciary, have been met, we expect the Prosecutor's Office to take the necessary actions in the shortest possible time to establish all the facts and prosecute those responsible, thereby sending an unambiguous message that the state of BiH is a country of the rule of law where laws apply equally to all its citizens, regardless of the positions entrusted to them," the statement said.
The Trade Union of Employees of the FMUP notes that the Constitutional Court of BiH, in its Decision on appeal AP-1117-17 (Anto Nedić, et al.) dated 12.03.2019, found a violation of the right to property, as well as a violation of the right to a fair trial, in relation to more than a hundred of their enforcement creditors, which, "if this approach of ignoring this problem by those responsible and their accomplices continues, will cause additional material damage and harm BiH's international reputation due to the subsequent submissions to the European Court of Human Rights in Strasbourg".
