Pivić on the Law on the HJPC: The Troika agreed to a bad legal solution that harms the state!

(Patria) - The House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina will consider the Proposal for amendments to the Law on the High Judicial and Prosecutorial Council of Bosnia and Herzegovina on Monday, July 24.

Legal expert Nezir Pivić (SDA) read the proposed legal draft and concluded that it involves poor legal solutions that are in direct contradiction with the opinions of the Venice Commission and numerous experts who have worked on this law project for years.

"It is impossible to hide personal and professional disappointment with the proposed solutions, which are contrary to the opinions and views of the Venice Commission and numerous experts who have worked on this law project for years. It is often said that political bargaining and personal interests must not take precedence over the rule of law, legal certainty, and the quality of legal regulation.

By accepting Zoran Tegeltija's amendments, the Troika agreed to a bad legal solution that harms the state but benefits personal and political interests.

Tegeltija's amendments limit the Integrity Unit within the HJPC of Bosnia and Herzegovina, deny public access to the register of related persons in the judiciary, reduce the circle of persons covered by conflict of interest in the judiciary, and generally weaken the capacity of the HJPC of Bosnia and Herzegovina and the judicial system of Bosnia and Herzegovina in the fight against corruption and conflict of interest.

The Troika supported Tegeltija's amendments at the 'historic' 11th session of the Council of Ministers. This is the same session at which Dodik's eastern interconnection was adopted. This is the same session after which the Minister of Foreign Affairs claimed that the southern interconnection was also adopted, which turned out to be untrue.

The entire project of the Law on the HJPC of Bosnia and Herzegovina was planned as the beginning of the path of judicial reform in Bosnia and Herzegovina, strengthening capacities to respond to corruption and conflict of interest, and ultimately strengthening citizens' trust in the judiciary.

What the Troika did at the 'historic session' was to adopt an amendment that is essentially against everything for which the project was initiated," wrote Pivić.
