OHR leaves no room for doubt: Constitutional Court clearly stated that state property is the property of the state of Bosnia and Herzegovina!

(Patria) - The Office of the High Representative (OHR) has once again commented on the issue of state property in BiH, which is resurfacing.

In a written response to "Glas Srpske" questions about whether and what kind of activities related to this topic are taking place within the OHR or parts of the international community, they pointed to the position of the Constitutional Court of BiH.

"The Constitutional Court has been very clear: the state is the holder of ownership rights over state property, and the Parliamentary Assembly of BiH has exclusive jurisdiction to regulate the issue of state property," the OHR stated.

They did not directly answer the question of whether there is a possibility for Christian Schmidt, in his capacity as High Representative, to repeal the Law on Prohibition of Disposal of State Property or to mitigate it for the sake of economic development, as requested by the leader of HDZ BiH Dragan Čović at the beginning of the year.

- The prohibition of disposal is, above all, a means of protecting the interests of the state in this process and ensuring compliance with the relevant decisions of the Constitutional Court of BiH. Within the prohibition of disposal, there is a mechanism that allows for special exceptions if it is in the public interest, and this is certainly one way to resolve the current blockade of important investment and development projects - the OHR stated.

The prohibition of disposal of state property has been in effect since 2005 by the decision of the then High Representative Paddy Ashdown.
