Schmidt's Decision: Which Conclusions of the National Assembly of Republika Srpska Have Been Annulled

(Patria) - High Representative Christian Schmidt has banned the application of conclusions adopted at the special session of the National Assembly of Republika Srpska on December 25 last year.

- The application of the following specific conclusions from Article 1 of this Order is prohibited:

- The National Assembly of Republika Srpska hereby obliges the Government of Republika Srpska to submit, within 30 days, a law for further procedure that will regulate the process of considering issues decided by the Parliamentary Assembly of Bosnia and Herzegovina in a way that the National Assembly of Republika Srpska takes a stance. first on these issues.

Conclusion No. 02/1-021-1563/24:

- The National Assembly of Republika Srpska tasks the Legislative Committee of the National Assembly of Republika Srpska to prepare amendments to the Bill on Personal Data Protection of BiH and a stance on the Bill on Border Control of BiH and submit them to the representatives of the Serb people in the Parliamentary Assembly of BiH."

Conclusions No. 02/1-021-1564/24:

- 4. The National Assembly of Republika Srpska notes that the legal system of the EU does not accept the possibility that an unelected foreign citizen makes laws instead of democratically elected institutions; the National Assembly of Republika Srpska demands that the appointed and elected representatives of the Serb constituent people of Republika Srpska in the joint institutions suspend decision-making in the domain of European integration until conditions are met that ensure the European integration process proceeds in accordance with the principles of democracy and the rule of law are met."

- 5. The National Assembly of Republika Srpska requests that acts resulting from the unconstitutional actions of a foreign individual, who according to the Constitution is neither an authorized proposer of laws nor a legislator, be annulled, and that deviations caused by such unconstitutional acts be rectified in order to proceed unimpeded towards the European Union.”

- 8. The National Assembly of Republika Srpska warns that European legal standards prohibit conducting inhumane and degrading judicial proceedings against persons at health risk, which the Court of BiH is currently doing, thereby moving Bosnia and Herzegovina away from the European path. The National Assembly of Republika Srpska considers that the President of Republika Srpska and the Director of the Official Gazette of Republika Srpska should stop responding to the summons of the Court of BiH, until the President of Republika Srpska is medically fit to participate in the proceedings."

- 9. The National Assembly of Republika Srpska requests that the appointed and elected representatives of the Serb constituent people of Republika Srpska in the joint institutions of BiH suspend decision-making at the BiH level, except in cases where decision-making relates to the transfer of competencies from Republika Srpska. to joint institutions or when the position of Republika Srpska is endangered in another way, until the European Union provides conditions and standards that enable a normal and fair trial in BiH, which is currently not the case due to the unconstitutional and illegal decision-making process of an unelected individual, whose stay in BiH can no longer be justified in any way."

- 11. The National Assembly of Republika Srpska notes that the abuse of the BiH Prosecutor's Office and attempts to interfere with the work of the highest representative body of Republika Srpska must be individually identified and prosecuted. Otherwise, the National Assembly of Republika Srpska will be forced, in order to protect the General Framework Agreement for Peace in BiH and the constitutional order of Republika Srpska, to take special measures to protect the Dayton Agreement."

- This order is issued in accordance with the international mandate of the High Representative and is not issued as a substitute for any domestic authority. It takes precedence over any inconsistent provisions of the Constitution of Republika Srpska, any law, regulation, or act, existing or future. This Order is directly applicable and no further action is required to ensure its legal effect - states the OHR decision.
