FBiH Constitutional Court Rules: Law on Allocation of Public Revenues Compliant with Constitution, Sarajevo Canton to Lose 86 Million KM Annually!

(Patria) - The Law on Allocation of Public Revenues of the FBiH is in accordance with the Rules of Procedure of the House of Representatives and the House of Peoples of the FBiH Parliament, and thus with the FBiH Constitution.

This is the decision of the FBiH Constitutional Court following an appeal concerning the Law on Allocation of Public Revenues, specifically the weight of 2, by which the coefficient for Sarajevo Canton was reduced from 1.965 to 1.5, resulting in 86 million KM less in the budget.

Amendments to this Law reduced the coefficient for Sarajevo Canton from 1.965 to 1.5, resulting in 86 million KM less in the budget.

"From all the above, it follows that the procedure for adopting the contested Law was carried out in accordance with the provisions of the Rules of Procedure of the House of Peoples regulating the procedure for adopting laws, when a law is proposed to the Federation Parliament by authorized proposers in the form of a draft.

The Constitutional Court of the Federation established that there was no violation of Article IV, point a, point 3.15 of the FBiH Constitution, because each house adopted the law in identical text, within a reasonable time, whereby the order of adoption of the contested law by the houses is not of parliamentary importance.

The allegations of the applicant that the contested law is unconstitutional because it was adopted based on a fiscal assessment statement made contrary to the provisions of the Law on Budgets in the FBiH, the rulebook on the procedure for drafting fiscal assessments of laws, other regulations and acts related to budget planning, and the instructions for filling out forms for fiscal change statements, were not considered by the FBiH Constitutional Court, as they relate to an assessment of legality, not constitutionality.

Based on all the above, it was decided as stated in the operative part of this judgment, thereby eliminating the need to decide on the interim measure," it is stated in the decision of the FBiH Constitutional Court.
