Strict penalties for reckless driving in BiH effective today: Up to 5,000 KM and vehicle confiscation

(Patria) - The Law on Amendments to the Law on the Fundamentals of Road Traffic Safety (ZOBS) in BiH, which defines reckless driving and introduces strict penalties for such offenses, comes into effect today, May 27, 2026.

For which offenses are the strictest penalties imposed?

  • Multiple red light violations

  • Drastic speeding

  • Overtaking over a solid line

  • Driving under the influence of alcohol above 1.5 permille

  • Driving under the influence of narcotics

  • Using radar jamming devices

The legal amendments, according to which the police will start acting from today, bring penalties of up to 5,000 convertible marks (KM).

Reckless driving is considered when a driver passes through a red light two or more times within a 20-minute period, as well as driving in a settlement at a speed that is 40 km/h higher than the maximum allowed, or outside a settlement at a speed 60 km/h higher than allowed.

Reckless driving also includes when a driver overtakes a column of vehicles by crossing a solid line or driving on it, as well as driving with an alcohol concentration greater than 1.50 g/kg or under the influence of narcotics or other psychoactive substances.

"An authorized person will temporarily confiscate the vehicle from the driver at the scene where they are caught driving recklessly, if it is determined that the driver has already been penalized for reckless driving once in the previous two years," the adopted amendments to ZOBS state.
