New Criminal Charges: Lukač Illegally Uses Official Vehicle and MTS Equipment!

Dragan Lukač, still the acting director of the Federal Police Administration on annual leave, awaits the decision of the FBiH Government, which seeks clarification from the Independent Board of the PSBiH that has again nominated Lukač for the position of FUP director, writes the Patria news agency.

However, it is more than clear that Lukač's four-year mandate expired on December 8, and legally he no longer has any connection with the FUP. Following all the events, FUP employees rightly wonder by what right Lukač, who is on annual leave, can still use the official vehicle, pistol, official documents, official mobile phone, uniform... for private purposes 24 hours a day.

- Formally and legally, Lukač has misappropriated the official vehicle and other MTS equipment and should not have used it under any circumstances. The story Lukač is now advocating, that the FBiH Government must relieve him of his duties because until it does so he is still the director, has no legal basis, because his mandate has legally and normally expired. And in such cases, one is not relieved of duty, but as the law stipulates, the deputy director of the FUP takes over management (until the election of a new director, editor's note) – says our source.

There are numerous criminal charges against Lukač in the Cantonal Prosecutor's Office and the Federal Prosecutor's Office, and a new one could be filed for abuse of position and unauthorized use of official vehicles and MTS equipment.

We remind you that Lukač already had more than 40 years of work experience at the beginning of 2014, and according to the Law on Police Officers of the FBiH, his status as a police officer should have ended and his employment relationship should have been terminated.

Even if we hypothetically assume that, as Lukač claims, he will complete 40 years of pensionable service next year in 2015, even in that case, applying the strict law, he cannot be appointed director of the FUP. This is because that article stipulates that the director's mandate lasts four years, and it is clear that Lukač then cannot be elected director.

- Well, how can someone be elected for four years when his status as a police officer expires in one year, and he is supposed to lead a police agency for four years – states our source.
