Neither tonight's celebration of January 9 has made the RS older than Dayton, nor will future ones

(Patria) - Years after the Constitutional Court of Bosnia and Herzegovina confirmed that January 9, as the Day of the RS, is unconstitutional, the authorities of this entity have continued to mark it with even more fervor, with even larger parades, with more attending officials from Serbia, and with even more meaningless speeches, writes Istraga.ba.

Tonight's pompous celebration did not hide the fact that the Constitutional Court of Bosnia and Herzegovina confirmed that the Bosnian-Herzegovinian entity Republika Srpska has no continuity with the para-state Republika Srpska formed on January 9, 1992.

Indeed, the sole purpose of designating January 9 as the Day of the RS was to prove continuity, as stated clearly by the member of the Presidency of Bosnia and Herzegovina, Željka Cvijanović, in 2019.

- The goal here is clear; they want to show that Republika Srpska did not exist before Dayton. The historical fact is that Republika Srpska was created before the war and before Dayton.

The RS was verified in Dayton by an important international treaty that ultimately keeps us together in Bosnia and Herzegovina - Cvijanović said at the time.

The unconstitutional celebration will not change reality. How important this is to the authorities in the RS is also shown by last year's statement by SNSD delegate in the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina, Radovan Kovačević, given as a response to the PIC's statement that entities are not states, that they exist solely on the basis of the Constitution of Bosnia and Herzegovina, and that they have no sovereignty of their own.

- The RS signed all annexes of the Dayton Peace Agreement, including Annex 4, the Constitution of Bosnia and Herzegovina, and Annex 10, which defines the appointment, powers, and rights of the High Representative.

In accordance with that annex, the High Representative in Bosnia and Herzegovina currently does not exist. In no annex or anywhere else have we encountered the existence of the PIC - Kovačević said.

Kovačević is right when he says that the RS signed the annexes, but not the para-state Republika Srpska, but rather the Bosnian-Herzegovinian entity Republika Srpska.

And it signed them only after the General Framework Agreement was signed, which was signed by the Republic of Bosnia and Herzegovina, the Republic of Croatia, and the Federal Republic of Yugoslavia, not by Republika Srpska.

The annexes are indeed an integral part of the agreement, but they are not the basic agreement on the basis of which the annexes were signed. So, the annexes are one thing, and the General Framework Agreement is another.

In this regard, the RS acquired the status of an administrative unit in Bosnia and Herzegovina through the General Framework Agreement, and only after that could it sign the Annexes.

In other words, the Republic of Bosnia and Herzegovina had previously given consent for the administrative units to appear in the annexes.

Consequently, Bosnia and Herzegovina has continuity confirmed by the General Framework Agreement for Peace, which is also confirmed by the Constitution of Bosnia and Herzegovina. And the entity RS does not have it.

Violation of the Dayton Peace Agreement, although they accuse everyone else of it, is carried out by RS officials through the celebration of January 9.

Republika Srpska has the choice to be a legal entity in Bosnia and Herzegovina, which it currently is, or to risk losing its own status by constantly attempting to weaken Bosnia and Herzegovina.

Exchanging an entity for a para-state is a huge risk.
