NES BiH: The Three's 'Growth Plan' to Undermine BiH's Sovereignty

(Patria) - The "experts" for economic growth, internal market, European integration, and
much more, from the Three, have recently been convincing citizens of BiH in public appearances that the Growth Plan is salvation for BiH, for the European integration process, for BiH's economy, emphasizing that there is nothing controversial about it and that they are ready to discuss each measure individually with critics of this document, NES announced.

"A slightly more serious analysis of the Growth Plan, which the Three are desperately defending, indicates that it is a deception and that it is actually a mechanism to support Dodik in continuing to undermine BiH. Unbelievable but true that Bosniak representatives in the Council of Ministers of BiH, for the first time in the history of BiH, are giving institutional support to those undermining BiH, and doing so publicly, while convincing the public that it is a saving solution for BiH.

As time goes by, citizens of BiH, the professional public, as well as many close associates of the leaders of the Three, realize that this is a catastrophically bad document that undermines the sovereignty of BiH. A large number of measures are trying to hide the essence, which is that at the request of RS, key measures for BiH concerning the Constitutional Court of BiH have been removed, and that the Law on Technical Regulations of RS (page 64 of the Growth Plan) has been included in this document, which states that the entity of RS will adopt the Law on Technical Regulations of RS, which the Constitutional Court of BiH has declared unconstitutional.

By accepting the unconstitutional law of RS in an official document of the Council of Ministers of
BiH, Dodik is given an instrument to oppose Decision 2/21 of the Constitutional Court of BiH, and that he can justify his unconstitutional activities by fulfilling the decisions of a legal state body – the Council of Ministers and BiH's international obligations towards the EU. In this way, legal chaos is created in which RS will continue its unconstitutional activities of appropriating BiH's competencies, undermining the internal market and the single economic space of BiH.


In such legal chaos, it is practically impossible to achieve economic growth
because the rule of law and legal certainty are prerequisites for creating an economic environment that can generate economic growth. An environment is being created in which contradictory legal norms in BiH will create conditions for even greater crime and corruption, and most of the funds from this plan will end up in private pockets, exactly what Dodik needs.

It is evident that the representatives of RS, during the drafting of this document, did not want to give up the unconstitutional Law on Technical Regulations under any circumstances, and insisted that it must be included in the Growth Plan at the cost of not adopting this document. This means that RS, under no circumstances, is giving up its plans to take over state competencies and undermine BiH.

Although the representatives of the Three knew that these were unconstitutional activities of RS, which the European Commission also warns about in its reports, demanding that RS cease blockades and that a single economic space of BiH be established (this disputed law is precisely the reason for the division of BiH's economic space), they nevertheless supported RS's request, thereby committing a criminal offense of non-compliance with the decisions of the Constitutional Court of BiH.

In this context, the fact that the Three are trying to impose a narrative in the public space by switching theses, claiming that all those who do not support the unconstitutional provisions of the Growth Plan are ill-intentioned towards BiH, and that Dodik is a constructive partner in this process, is particularly concerning.

If the Three, with an official document of the Council of Ministers of BiH, recognize the unconstitutional law of RS, which undermines BiH's internal market and appropriates BiH's competencies in foreign trade policy, as part of BiH's legal framework, then that same Three are acting against the interests of BiH and generating Dodik's narrative of dividing BiH. Practically, the story of betraying BiH's interests is coming to light and getting its epilogue in this specific example.

And we remind you that the Constitutional Court, by its Decision U 2/21, determined that the Law on
Technical Regulations of RS is not in accordance with the Constitution of Bosnia and Herzegovina, and emphasized, "Analyzing this issue, the Constitutional Court reminds that the Parliamentary Assembly of BiH, within the scope of its powers under Article IV/4.a)
of the Constitution of Bosnia and Herzegovina, adopted the existing Law on Technical Requirements, which was published in the 'Official Gazette of BiH' No. 45/04.”

The Constitutional Court further states: "The purpose of this law, as derived from the provisions of Article 2, is to harmonize technical regulations in Bosnia and Herzegovina with European Union directives, with the Ministry of Foreign Trade being responsible for harmonizing technical regulations.

The Ministry acts based on the proposal of the Committee for Technical Regulations of BiH, composed of representatives (ministers) from the state and entity levels of government, and Brčko District of BiH. The aforementioned law is structured into seven chapters, within which, in twenty-one legal provisions, issues related to the method of prescribing and the procedure for assessing technical requirements for products placed on the market of BiH are regulated.

In this regard, the obligations of legal and natural persons placing products on the market in BiH (Article 5), the bodies that adopt technical regulations (Article 6), the bodies involved in assessing the conformity of products with technical regulations (Article 12), and the supervision of the implementation of the Law on Technical Requirements (Article 14) are defined,” NES stated.
