
The Economic Crime Department of the Cantonal Prosecutor's Office of Sarajevo Canton, after conducting an investigation, collected sufficient evidence and filed an indictment against Bechir Mekni for the criminal offense of Concluding a Harmful Contract, and against Safet Ibrović for the criminal offense of Negligent Work in Service, reports the Patria news agency.
The first defendant is charged with, in the period from 2010 to 2013 in Sarajevo, as a responsible person in the capacity of Chairman of the Supervisory Board of "Magros Veletrgovina," concluding a Real Estate Sale Agreement contrary to regulations with the buyer "SHAD INVEST," knowing that the agreement was detrimental to
the interests of "Magros Veletrgovina." By concluding such an agreement, money was extracted from "Magros Veletrgovina," and damage was caused to "Magros Veletrgovina" not only in the amount of the price determined in the purchase agreement of 2,034,903.11 KM, but also in an undetermined amount of lost profit for new investments, working capital, or covering part of the losses, while the same amount benefited the legal entity SHAD INVEST.
The second defendant, Safet Ibrović, is charged with, in the period from 2010 to 2012 in Sarajevo, as a responsible person in the capacity of director of "Magros Veletrgovina," acting negligently, in that after the Supervisory Board made a decision on the sale of the residential building – Poljine on March 27, 2010, and authorized Mekni, in his capacity as Chairman of the Supervisory Board, to sign on behalf of "Magros Veletrgovina" the Real Estate Sale Agreement of August 9, 2010, with the buyer "SHAD INVEST" doo Sarajevo, represented by director T.Č., whose founder and 100% owner is Al Shiddi Sulaiman Abdullah Mohamed, who is also the buyer of "Magros Veletrgovina" dd Sarajevo, as a member of the partnership group under the State Capital Purchase Agreement of February 3, 2006, and Chairman of the Assembly, and from November 30, 2011, director of "SHAD INVEST" doo Sarajevo, although he knew that the conditions and manner of concluding the said Agreement were detrimental to the interests of "Magros Veletrgovina" dd Sarajevo, he did not take, in accordance with his powers, actions that would have prevented the conclusion of such an agreement.
