Mehmedović: Kajganić should be dismissed due to numerous omissions, BiH institutions are in political captivity

(Patria) - State MP Šemsudin Mehmedović held a press conference today, warning about the situation in the country, and particularly about the inaction in police and judicial institutions, as well as other illegalities.

At a time when geostrategic tectonic shifts are occurring on the world stage, when aggressive actions are being taken against the Dayton Peace Agreement, state institutions such as the Prosecutor's Office of Bosnia and Herzegovina, SIPA, the Indirect Taxation Authority, and the House of Peoples of Bosnia and Herzegovina are either completely blocked or politically misused and in political captivity.

"We are witnessing an unprecedented lobbying offensive and attack in the United States and globally, aimed against Bosnia and Herzegovina, against the people who were victims of genocide, and against peace and stability in the region. I warn that the key rule of law institutions, judicial, executive, and legislative in Bosnia and Herzegovina are practically blocked! An UNIFIED ADMINISTRATIVE UNDERTAKING is underway to capture institutions by the HDZ-SNSD axis.

We are currently in a very dramatic moment, with a very real danger that, based on global turmoil, lobby-paid disinformation and falsehoods, Bosnia and Herzegovina will be pushed back towards division and instability, rather than towards the European Union and NATO, where we should have been long ago.

A Goebbels-style campaign is being waged against Bosnia and Herzegovina and its most numerous people. Bosniaks are being presented as an emerging threat, as Max Primorac wrote in a pamphlet full of lies and deception yesterday, published by the Washington Times, and reported by certain so-called media in our country. Various Luburićs are spreading identical fascistoid political propaganda from which we freed ourselves in '45 and '95, or at least we thought so. On our side, we have the truth and numerous final decisions of the Hague Tribunal, which ruled on two joint criminal enterprises conceived in Belgrade and Zagreb, defeated militarily, legally, and politically. It also definitively established genocide against Bosniaks, and in hundreds of verdicts confirmed that the gravest forms of war crimes, crimes against humanity, etc., were committed against members of the Bosniak people," states Mehmedović.

He pointed out that today we are witnessing the persecution of Bosniaks, SIPA mostly arrests Bosniaks, inspection supervision is carried out only on Bosniaks and their companies, only they are punished, roads are mostly built where non-Bosniaks live, and we pay over 80% of taxes in Bosnia and Herzegovina, we pay the RTV fee.

"Furthermore, Bosniaks are presented in the West as a danger to the European Union and Christianity in general through fascistoid outbursts of hatred by politicians from the RS, who use our money to pay lobbying firms around the world. The HDZ is increasingly and more openly accepting this narrative. Bosniaks, as the most numerous people, making up over 50% of the population, have had all levers of decision-making usurped. So who is threatened here, and by whom? If the Prosecutor's Office of Bosnia and Herzegovina had done its job in previous years, much would be different today. For example, the commission of some of the most serious criminal offenses, 'attack on the constitutional order' and 'abuse of official position,' were not enough for the Prosecutor's Office to do its job.

Precisely because of the well-founded suspicion that he committed several criminal offenses, including the two mentioned above, my colleague Jasmin Emrić and I filed a criminal complaint against Darko Ćulum, former director of SIPA, with the Prosecutor's Office of Bosnia and Herzegovina on July 21, 2025. Seven months have passed since then, and the acting prosecutor Igor Dubak has done absolutely nothing on this matter, except that we were informed that a case has been opened and is active. It is unacceptable that the Prosecutor's Office has not been able to determine in seven months what is clear to any legal layman, namely that Darko Ćulum illegally usurped the position of SIPA director and must be held criminally responsible for it! This is probably a unique case in the world where a person who attacked the constitutional order of a country continues to illegally head the most important police agency.

The situation is the same with the criminal complaint we filed in July 2025 against Borjana Krišto for abuse of official authority related to the non-appointment of Nebojša Vukanović as Minister of Security, but Vedrana Mijović, as the acting prosecutor, has also done nothing to date. It is undisputed that prosecutors Dubak and Mijović are unjustifiably delaying actions related to the performance of their prosecutorial duties, thereby clearly committing a disciplinary offense."

For the inaction and possible abuse of official authority by the mentioned prosecutors, the Chief Prosecutor Milanko Kajganić must also bear responsibility, as it was his obligation to file disciplinary complaints against the mentioned prosecutors. In addition to the aforementioned irregularities, prosecutor Kajganić has lowered the reputation of the Prosecutor's Office to the lowest possible level, and citizens have absolutely no faith in the Prosecutor's Office. He is clearly part of the unified administrative undertaking himself and is blocking the work of the Prosecutor's Office.

The fact is that the Deputy Chief Prosecutor Džermin Pašić filed a criminal and disciplinary complaint against Kajganić for suspending the investigation against Milorad Dodik, Nenad Stevandić, and Radovan Višković, claiming there was no criminal offense of attack on the constitutional order, even though the entire country witnessed live the commission of this planned and coordinated criminal offense. Furthermore, the public is disturbed by Kajganić's prohibition of sending indictments for war crimes in Sanski Most for confirmation, for which state prosecutor Izet Odobašić filed a criminal and disciplinary complaint against the Chief State Prosecutor. Kajganić has also blocked other criminal cases: the air bombing of Tešanjka, the murder of reapers in Kraševo, the 1425-day siege of Sarajevo, etc. Due to all the aforementioned documented accusations of abuse of official position and conscious prevention of war crimes prosecution, I demand the immediate suspension, dismissal, and initiation of criminal proceedings against Chief Prosecutor Milanko Kajganić.

I call on the President of the HJPC, Sanin Bogunić, to act in accordance with his authority, because he should not express concern as the High Representative and other representatives of the international community do. Bogunić must act urgently in accordance with the law," stated Mehmedović.

He stated that tenders in public institutions are also being rigged and called for the latest tender for four assistant directors of the ITA to be annulled.

"If Director Tegeltija, contrary to the law, decides to appoint only Serbs and Croats to the four positions of assistant director, I call on Bosniak candidates to exercise their legal right and file lawsuits for ethnic discrimination during appointments to management positions in the Administration.

Bosniaks must be appointed to at least two positions to partially mitigate the imbalance of Bosniaks, as only one-fifth of Bosniaks are in key positions of heads of customs affairs departments and heads of legal affairs departments. Director Tegeltija has been consciously discriminating against Bosniaks for over two years by preventing their employment in accordance with the proportional representation of constituent peoples, although Article 7, Paragraph 4 of the Law on the Indirect Taxation Authority clearly stipulates that the structure of employees in the Administration and its organizational units reflects the ethnic structure of the population of Bosnia and Herzegovina according to the last census. There are currently 226 fewer Bosniaks employed in the Administration than the legally prescribed number, and Tegeltija will, sooner or later, be held accountable for illegal work.

He also informed the public about the problems in the Secretariat of the Parliamentary Assembly of BiH_

- inability of Bosniaks to advance in service, except for a few who were "lucky," while officials from the other two constituent peoples advance to the highest management positions as they wish;
- illegal appointments to commissions for which compensation is paid;
- illegal and unfair decisions on official travel to the detriment of Bosniaks. Only the obedient are rewarded with this privilege.

In addition, the Collegium of the Secretariat, since October, by agreement with Marinko Čavara, refuses to respond to my parliamentary questions, which means they are united in the task of preventing MPs from exercising parliamentary oversight! In the same period, the Secretariat promptly provided an answer to Sanja Vulić's question. I believe that due to all of the above, there are grounds for suspicion that the members of the Secretariat Collegium – Mirza Imamović, Gordana Živković, and Dražen Mustapić, as responsible persons, have committed a criminal offense under Article 224, Paragraph (1) of the Criminal Code of Bosnia and Herzegovina, in conjunction with Articles 6, 16, and 61 of the Law on Parliamentary Oversight.

He also warned about the difficult situation at BHRT, which is the result of the long-term non-implementation and violation of the provisions of the Law on the Public Broadcasting System of Bosnia and Herzegovina.

"Since 2017, Radiotelevizija Republike Srpske, by a unilateral decision and contrary to the Law, has stopped paying RTV fee funds into the unified account. The RTV fee, which finances BHRT and Federal Television, is collected only in one part of the Federation, through Elektroprivreda Bosne i Hercegovine, while in cantons supplied with electricity by Elektroprivreda HZHB, the fee has not been collected at all since 2015, because the HDZ prevents it, whose officials publicly call not to pay the RTV fee.

The strategic goal of SNSD and HDZ is the shutdown of the state public service, and they do not hide it. While only Bosniaks pay the RTV fee, SNSD and HDZ cadres receive enormous compensation in the Management Board and high salaries in editorial positions. This is the ideal scenario for SNSD and HDZ: Bosniaks finance, they manage.

Due to the possibility of BHRT ceasing operations, I asked the High Representative in Bosnia and Herzegovina, Christian Schmidt, in a parliamentary question on January 15, whether, in accordance with his powers granted by Article V of Annex 10 of the General Framework Agreement for Peace in Bosnia and Herzegovina, he intends to make a decision to urgently allocate funds of 50 million convertible marks to BHRT from the accumulated reserve for equalization from excise revenues for road tolls, which are in a special account of the Central Bank of Bosnia and Herzegovina, in the same way that he allocated 120 million convertible marks to settle the debt of Republika Srpska in the case of Vidauct d.o.o. Portorož? I have not received an answer to date.

When the High Representative in Bosnia and Herzegovina made the Decision to allocate funds from road tolls from the special account of the Central Bank of Bosnia and Herzegovina, in the amount of 120 million convertible marks, to settle the debt of Republika Srpska in the Vijaduct case, he should have, by the same decision, allocated 181 million KM collected from road tolls to the Federation of Bosnia and Herzegovina, because those funds belong to it by law. The High Representative should have known that Srđan Amidžić, as Milorad Dodik's closest associate and an open secessionist, would continue to illegally block these funds. I still believe that it is high time for the High Representative, in accordance with his powers, to act urgently and make a decision to allocate 50 million KM from excise taxes for road tolls to BHRT," stated Mehmedović.
