Mehmedović reports prosecutor Jolović to HJPC: FBiH is damaged by 700 million KM, and she has not acted on the report for 11 months!

(Patria) - State MP Šemsudin Mehmedović filed a complaint against BiH Prosecutor's Office prosecutor Bojana Jolović with the High Judicial and Prosecutorial Council on September 2, 2025, due to a breach of official duty.

In the explanation to which Patria had insight, Mehmedović states that on October 3, 2024, he filed a criminal complaint against the members of the Management Board of the Indirect Taxation Authority of BiH on suspicion of committing the criminal offense of abuse of official position or authority, in a way that they damaged the Federation of BiH by approximately 370 million KM, for the benefit of the Republika Srpska entity.

In January 2025, Mehmedović received a response from the BiH Prosecutor's Office stating that no order to not conduct an investigation or any other final decision has been made in case T20 0 KTK 0026097 24.

To a further parliamentary question on June 25, he received a response from Chief Prosecutor Milanko Kajganić, informing him that "the acting prosecutor is verifying the allegations from the relevant report."

Given that Mehmedović continued with additional questions, he received a third response on August 20, also signed by Chief Prosecutor Kajganić:

"After verification through the official records of the Prosecutor's Office of Bosnia and Herzegovina and analysis of the collected data, we inform you that the State Investigation and Protection Agency has not submitted a report on the measures and actions taken under the order of the BiH Prosecutor's Office, which report will determine the steps to be taken in order to make a final decision."

Mehmedović states in his complaint to the HJPC that Bojana Jolović is also the head of the Corruption Department of the Special Department for Organized Crime, Economic Crime, and Corruption of the BiH Prosecutor's Office and that for 11 months she has not taken any measures or actions in a high-profile corruption case.

"Also, it is not at all problematic for Chief Prosecutor Kajganić that after 11 months the acting prosecutor is 'waiting' for SIPA to do something, even though the chief prosecutor states in his response to the parliamentary question that 'the acting prosecutor is verifying the allegations from the relevant report'. The actual situation is that the prosecutor and SIPA have done absolutely nothing for 11 months, which is unacceptable," states Mehmedović.

He further points out in the complaint that the reported criminal offense "continues unhindered and the damage to FBiH is now around 700 million KM, and the reaction of the responsible prosecutor and the chief prosecutor has been absent.

He informed the HJPC that no one had questioned him as the complainant, nor is he aware whether the BiH Prosecutor's Office intends to take any action.

"Due to all of the above, in accordance with Article 64, Paragraph 2 of the Law on the HJPC of BiH, I am filing a complaint against Bojana Jolović, a prosecutor of the BiH Prosecutor's Office. I believe it is undisputed that Bojana Jolović has committed a violation established by Article 57, Paragraph 1, point d) of the Law on the HJPC, for unduly delaying the implementation of official actions related to the performance of the prosecutor's function, and I request that Bojana Jolović be issued an appropriate disciplinary measure."

Mehmedović submitted all responses from the BiH Prosecutor's Office to the HJPC, as well as his parliamentary questions from December 2024, and from May and July of this year.

It should also be recalled that the Management Board of the ITA has not held a session since April because the members cannot agree on the coefficients for the distribution of road toll revenue. Due to the lack of agreement, there were 316 million KM in undistributed funds in the account, and by the decision of the High Representative Christian Schmidt, this money was used to pay off Viaduct's debt of 120 million KM, which the Republika Srpska entity was supposed to pay, and the same amount was paid into the FBiH Budget, even though it is an unfair distribution. Although Schmidt pointed out that the Republika Srpska entity would not receive money until FBiH was compensated if an agreement on different coefficients was reached, in this political situation, no one is even mentioning a new distribution and coefficients anymore.

The Deputy Minister of Finance and Treasury, Muhamed Hasanović, also recently stated that the Federation of BiH maintains the financial stability of both the Republika Srpska entity and the Brčko District when it comes to ITA funds.

However, someone is not interested in finally establishing realistic coefficients and for FBiH to receive the money it rightfully deserves.

In the past two years, Minister of Finance Toni Kraljević has advocated for such a position and therefore refused to agree to the distribution of money according to previous coefficients. However, Schmidt is clearly above any law and economic expertise.
