
(Patria) - On behalf of the caucuses of SDA, DF, and SBiH in the House of Representatives of the Parliament of the Federation of BiH, the SDA representative in the House of Representatives of the FBiH officially submitted a request yesterday to the Vice President of the Federation of BiH Lidija Bradara and Vice Presidents of the Federation of BiH Refik Lendo and Igor Sojanović to, in accordance with their constitutional obligation, take action to protect constitutionality in the Federation of BiH.
Vice President of the FBiH Refik Lendo, in a statement for Patria on this occasion, says: "The appointment of judges to the Constitutional Court of Bosnia and Herzegovina is a generational decision with potentially decades-long consequences for the political sovereignty, territorial integrity, and constitutional-legal order of the state of Bosnia and Herzegovina.
The Constitution of Bosnia and Herzegovina contains a provision obligating the House of Representatives of the Parliament of the Federation to elect judges to the Constitutional Court of Bosnia and Herzegovina. Therefore, the term 'election' means choosing from among multiple candidates proposed to them, with the aim of selecting the best candidate".
He adds: "The fact that the Election and Appointment Commission submitted only one name to the House of Representatives indicates a violation of the procedure in which the Commission made the selection and submitted its decision to the House of Representatives for confirmation".
"Therefore, I can freely say that this is primarily a violation of the representatives' right to choose from multiple candidates, as well as a removal of the competence of the House of Representatives, which has been placed in a position to confirm an election made by a body subordinate to it," Lendo told Patria and concluded:
"I hereby call on the representatives in the House of Representatives of the Parliament of the Federation to make a personal decision during the vote, based on the professional and expert competencies of the candidate Marin Vukoja, whose name has been submitted to them for confirmation. They are especially obliged to take into account the views and opinions of the citizens and voters who voted for them, and to ask themselves whether they would support their choice?".
