(Patria) - The rule of law is one of the pillars of every democratic society, said Federation Vice President Refik Lendo.

"In its essence, it contains the obligation for everyone to respect and implement positive legal regulations, especially the Constitution as the act of the highest legal force.

From the above, a special obligation arises for holders of functions in the executive and legislative authorities to strengthen citizens' trust in the rule of law and state institutions through their own lawful conduct," Lendo adds.

As he says, "another pillar of a democratic society is sharp political debates, which we are obliged to keep within the framework of a culture of dialogue, with special regard to the platform we have and the consequences that threaten."

"The election of Marino Vukoja to the Constitutional Court of Bosnia and Herzegovina contains such a level and intensity of opposition to legality that a constitutional dispute has arisen as a consequence between the state of Bosnia and Herzegovina and the House of Representatives of the Parliament of the Federation.

Because one parliamentary commission, contrary to the provisions of Article VI/1 a) of the BiH Constitution, assumed the competencies of the House of Representatives, carried out the election of a judge instead of the House of Representatives, and then sent such an unconstitutional decision to the House of Representatives for confirmation," Lendo points out.

He states that the delegates, as directly elected representatives of the citizens, were denied the constitutional right to choose from a list of multiple candidates.

"Instead, only one name was submitted to them for confirmation.

On the other hand, the competition procedure for the election of judges to the Constitutional Court of the Federation is conducted by the High Judicial and Prosecutorial Council of BiH, which compiles a list. The election is carried out by the President of the Federation with the consent of the Vice President of the Federation. The House of Peoples confirms the election.
On one hand, parliamentarians cannot influence the election of judges to the Constitutional Court of the Federation. On the other hand, parliamentarians control the entire process of electing a judge to the Constitutional Court of Bosnia and Herzegovina," Lendo concluded.
