Lawyers Senad Kreho, Damir Kočo and Damir Beglerović have submitted a request to the Bar Association for protection, and for actions to be taken to protect the right to practice law and the right to defense in accordance with the UN Basic Principles on the Role of Lawyers from 1990 and the European Convention on Human Rights and Fundamental Freedoms.
Lawyer Alen Nakić confirmed for Patria that he will also file disciplinary charges against the presiding judge Adisa Zahiragić.
"Of course, as their attorney, I will not wait for the Bar Association to exclusively protect the rights of my clients, but I will certainly, in accordance with positive legal regulations, initiate proceedings to protect their rights, and prosecute judge Zahiragić Adisa, both before the Disciplinary Prosecutor's Office of the HJPC BiH and before the competent Prosecutor's Office, all considering that her actions also constitute elements of a criminal offense under Article 357 of the Criminal Code of the Federation of Bosnia and Herzegovina," Nakić stated.
We remind you that the judge of the Cantonal Court in Sarajevo did not allow Kreho and Kočo to represent the suspects in the murder of the Swede Haris Osterdal.
The session was supposed to consider the proposal of the KS Prosecutor's Office to impose one-month detention on the three suspects Oliver Herbert Peter, Abdel Majid el-Oveitay and Konrad Tilus.
The judge had previously excluded the public from the session.
In the request sent to the Bar Association, it is stated that the Court, through the presiding judge Zahiragić Adisa, violated the rights of lawyers Kreho Senad and Kočo Damir to practice law in an extremely rude and unprofessional manner. Furthermore, it is emphasized that the judge also violated the rights of the suspects.
"The fact that the presiding judge Zahiragić attempted to forcibly remove lawyers Kreho Senad and Kočo Damir from the courtroom by order to the court police, which they opposed by defending the dignity of the profession despite the judge's unlawful actions, and prevented further unlawful actions in this regard, clearly testifies to the arrogance and unprofessional conduct in this specific case," it is stated.
In relation to the incident in question, it is requested to convene an urgent extraordinary session of the Management Board, and that lawyer Nakić and lawyers Kreho, Kočo and Beglerović be invited to it, in order to further explain the facts and arguments stated in the request, and to submit additional evidence in this regard.
