Bosniak Club in the RS Council of Peoples did not withdraw vital national interest: Appeal to the Constitutional Court of BiH ready

(Patria) - The Bosniak Club in the Council of Peoples of the Republika Srpska did not withdraw the vital national interest regarding four disputed laws passed on February 27 in the National Assembly of the RS. This means that the President of the RS, Milorad Dodik, can sign the decree so that the law is published in the Official Gazette of the RS.

The National Assembly of the Republika Srpska adopted the Law on Non-Application of Laws and Prohibition of Activities of Unconstitutional Institutions of BiH. It is stipulated that the laws on the Court of BiH, the Prosecutor's Office of BiH, the State Investigation and Protection Agency of BiH, and the High Judicial and Prosecutorial Council of BiH will not be applied or enforced on the territory of the Republika Srpska.

Delegate of the Bosniak Club Dževad Mahmutović (SDA) confirmed that he abstained at the club meeting and believes that the entire procedure would be further prolonged, and that an appeal to the Constitutional Court of BiH is already prepared.

"The argumentation we use has not passed so far at the Constitutional Court of the RS. We consider BiH to be our vital national interest, and these laws attack Bosnia and Herzegovina. So that we do not drag this matter through the Constitutional Court of the RS and give time to Dodik and everyone else to procrastinate, let him sign and let these laws go to publication. We have prepared an appeal to the Constitutional Court of BiH for the assessment of the constitutionality of these laws. We are waiting for the publication and they will be immediately challenged before the Constitutional Court of BiH," says Mahmutović.

He emphasizes that these are unconstitutional laws.

"This is well explained in the submissions that are already prepared for the Constitutional Court of BiH. The transfer of competencies was done in accordance with the agreement of the two entities, in accordance with the Constitution of BiH, and there is no defined way for the return of competencies or for any level of government to change these laws or challenge them. We expect that the Constitutional Court of BiH will react quickly, and we have also requested a temporary measure," said Mahmutović for Hayat.

"We are waiting for these laws to be published and then we will go to the Constitutional Court of BiH. Within these requests, there is also a request for a temporary measure. I expect that the Constitutional Court of BiH will, very soon after the entry into force and submission of our requests, ban the application of these laws until a final decision," said Mahmutović.
