
(Patria) - Democratic Front MP in the House of Representatives of the Federation Parliament, Dennis Gratz, today submitted an initiative to the BiH Constitutional Court to review a potential breach of duty regarding the attendance of BiH Constitutional Court judge Marin Vukoja at the concert of Marko Perković Thompson in Široki Brijeg.
In his parliamentary question to the BiH Constitutional Court, Gratz points out that symbols and insignia associated with the Ustasha ideology were displayed at the concert attended by Vukoja, along with greetings and slogans historically linked to the Independent State of Croatia (NDH).
Considering the constitutional position and special responsibility of the judges of the BiH Constitutional Court, the obligation to preserve the dignity of the office and public trust, and the importance of the perception of impartiality of the constitutional court institution, he posed several questions.
"Is the BiH Constitutional Court aware of the aforementioned information regarding the judge's attendance at the event in question?", reads the question in the initiative.
Gratz also asked whether the Court has considered whether such attendance, in the context of the publicly documented content of the event, could affect the perception of impartiality and integrity of the judicial office.
"Does the BiH Constitutional Court have an internal code of ethics or rules of conduct that regulate public appearances and attendance at public gatherings by judges? Will the Court examine the relevant circumstances to determine whether there has been a violation of obligations arising from the constitutional office?", states Gratz.
The decision on dismissal is made by the BiH Constitutional Court itself, i.e., the other judges of that court, not by the Parliament of the Federation of BiH which appointed him or the executive branch.
According to the BiH Constitution and the Rules of the Constitutional Court, the BiH Constitutional Court, or its president, can independently initiate dismissal proceedings against a Constitutional Court judge in case of damage to the institution's reputation.
