
(Patria) - Decisions of the Constitutional Court, in accordance with the Constitution of Bosnia and Herzegovina, Article 6.5 of the Constitution and Article 72 of the Rules of the Constitutional Court, are final and binding, and every natural and legal person is obliged to respect and implement them, stated the President of the Constitutional Court of Bosnia and Herzegovina, Valerija Galić, in an interview for BHRT, speaking about January 9th, a date that is unconstitutionally celebrated as the day of the entity of Republika Srpska.
- Non-implementation, or rather, non-execution of the decisions of the Constitutional Court, in accordance with Article 239 of the Criminal Code of Bosnia and Herzegovina, represents a criminal offense within the jurisdiction of the Prosecutor's Office of Bosnia and Herzegovina for prosecuting eventual perpetrators, emphasized Galić.
- According to the aforementioned provision of the Criminal Code of Bosnia and Herzegovina, an official or responsible person in all bodies of authority in Bosnia and Herzegovina, or at all levels of government, who does not implement, apply, execute, or in any way prevent or obstruct the execution of decisions of the Constitutional Court, including interim measures, commits a criminal offense for which a penalty of six months to five years is prescribed", reminded the President of the BiH Constitutional Court, Valerija Galić.
She stated that the Constitutional Court of Bosnia and Herzegovina has no information about the activities of the BiH Prosecutor's Office regarding the sanctioning of those who do not respect the decisions of the Constitutional Court of Bosnia and Herzegovina, specifically concerning January 9th as the day of Republika Srpska. Galić considers the very fact that this date is celebrated in Republika Srpska, despite the decisions of the Constitutional Court, to be devastating.
"I said at the beginning that the decisions of the Constitutional Court are final and binding and that they should be executed. Of course, considering that Bosnia and Herzegovina aspires and wishes to be a member of the European Union, the non-execution of the Constitutional Court's decisions, which undermines the authority of the Constitutional Court of Bosnia and Herzegovina and, generally speaking, the rule of law in Bosnia and Herzegovina, is indeed a devastating fact", stated Galić in an interview for BHRT.
