
(Patria) - The owner of the company "Srebrena malina" Fikret Hodžić was released today from the state prison in Vojkovići, his lawyer Mirna Avdibegović confirmed to Patria.
To recall, on November 14, the Constitutional Court of BiH overturned the verdict of the Appellate Panel of the Court of BiH, by which Hodžić was sentenced to five years in prison in the "Respirators" affair. He had been serving his prison sentence since March 14.
Hodžić was released from prison after the Court of BiH received the decision of the Constitutional Court of BiH in the case "Fadil Novalić and others" today.
"After the annulment of the conviction, according to the provisions of the Law on Enforcement of Criminal Sanctions, Detention and Other Measures of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms, Hodžić can no longer be serving his prison sentence.
Namely, after the decision of the Constitutional Court of BiH, the causal link between the existence of a final verdict and deprivation of liberty was lost, which is why he must be released immediately, all in accordance with Article 5 of the European Convention on Human Rights and Fundamental Freedoms.
The public will be informed in a timely manner about further procedural actions, i.e., the session of the Appellate Panel, which will be scheduled for the purpose of re-examining the appeals of the accused Fikret Hodžić and the legal entity 'F.H. Srebrena malina', in the part as specified by the decision of the Constitutional Court of BiH", it was announced today from the Court of BiH.
