Džermin Pašić files criminal complaint against his boss Milanko Kajganić

(Patria) - Deputy Chief State Prosecutor Džermin Pašić has filed a criminal complaint with the BiH Prosecutor's Office against his boss - Chief Prosecutor Milanko Kajganić and prosecutor Vedrana Mijović for their actions in the case of an attack on the constitutional order, in which the investigation against Milorad Dodik, Radovan Višković, and Nenad Stevandić was dropped, Detektor has learned.

Pašić submitted the complaint to the Special Department for Organized Crime, Economic Crime, and Corruption of the State Prosecutor's Office today against Kajganić and Mijović on suspicion of protecting Dodik and the other two suspects, a source from the judiciary confirmed.

As stated in the complaint, which Detektor had access to, it is also being submitted to the High Judicial and Prosecutorial Council (HJPC) of BiH, the Disciplinary Prosecutor's Office, the Commission for Combating Corruption of the House of Representatives of the BiH Parliament, the Office of the High Representative, the EU Delegation to BiH, and the OSCE Mission to BiH.

Pašić declined to comment on the criminal complaint.

The complaint states that Kajganić and Mijović, between January 22 and November 3, 2025, in order to protect Radovan Višković, Milorad Dodik, and Nenad Stevandić from criminal proceedings for the criminal offense of "attack on the constitutional order," committed the criminal offense of "abuse of office or authority."

As stated in the complaint, after the case was formed in the Prosecutor's Office, it was automatically assigned to Vedrana Mijović, who was then joined by a joint investigation team on January 24, 2025, by decision of the Chief Prosecutor.

This team issued a decision to conduct, and then expand, the investigation against Višković, Dodik, and Stevandić on suspicion of committing the criminal offense of "attack on the constitutional order."

Based on this, a motion for detention was sent, which the Court of BiH accepted, and ordered the issuance of an arrest warrant.

Pašić states in the complaint that Kajganić and Mijović had an agreement to keep Mijović as the sole prosecutor during the investigation, thereby, as Pašić states in the complaint, Kajganić "used his official position as Chief Prosecutor" and made a decision in June 2025 to revoke the decisions on forming the prosecutorial team.

It is further added that the cancellation of detention and withdrawal of arrest warrants were agreed upon, which Pašić considers an overreach of authority, as well as entering into contact with the suspects and their lawyers.

It is further stated that on July 4 and 9, contrary to the Criminal Procedure Code and the detention order and issued arrest warrants, "the suspects - who accessed the official premises of the Prosecutor's Office in a known manner - were questioned by the second-accused and then submitted motions to the Court to lift the detention measures, without informing the police authority of the suspects' presence."

Therefore, Dodik, Višković, and Stevandić were not deprived of liberty or detained, nor brought to court in accordance with the decisions made.

Thus, without prior revocation of the Prosecutor's Office's order and notification of the police agencies to whom it was issued due to the existence of detention reasons, the suspects were allowed to leave the official premises, and no measures to secure the proceedings based on detention reasons were proposed to the Court, the complaint states.

After that, in order to create conditions for a decision to drop the investigation in this case without internal control, Vedrana Mijović - with the consent of Milanko Kajganić - questioned the Head of Department, thereby preventing him from supervising the work on this case, and on October 30, 2025, Mijović, with Kajganić's consent, issued an order to drop the investigation against Dodik, Stevandić, and Višković.

"(...) without having previously fulfilled their official duties of prosecuting perpetrators of criminal offenses and concluding the investigation with a sufficiently clarified state of affairs, nor did they inform the injured party (Legal Representative of Bosnia and Herzegovina) of the decision made, thereby making the securing of the constitutional order of BiH and the observance of legality on its territory ineffective," it is stated.

"By this, they benefited Višković, Dodik, and Stevandić in the form of protection from criminal proceedings before the Prosecutor's Office and the Court of BiH, i.e., prevented the process of determining their criminal responsibility for the actions of the criminal offense, being aware of the existence of real reasons for securing the presence of the suspects and the successful conduct of the proceedings, as well as the existence of evidence of the committed criminal offense for which they were suspected," the complaint states.

In the list of evidence cited in the complaint, Pašić attached a letter to the High Judicial and Prosecutorial Council regarding continuous actions threatening rights and independence dated October 7, 2025.

The spokesperson for the BiH Prosecutor's Office requested a written inquiry for confirmation of receipt of the criminal complaint and comment, to which no response was received by the time of publication. Kajganić did not respond to calls and messages for comment, while Mijović referred journalists to the spokesperson for the BiH Prosecutor's Office.
