A historic decision is awaited on Izetbegović's appeal: RS only exists from Dayton, not from 1992!

Panic has "justifiably" gripped the political scene in Republika Srpska in the last ten days, writes the Patria News Agency. 
 
If the BiH Constitutional Court, based on the appeal filed by the Bosniak member of the BiH Presidency, Bakir Izetbegović, for an assessment of the constitutionality of the articles of the Law on Holidays of RS, which establish January 9th as the Day of the Republic, decides that these articles of the Law are unconstitutional, it will not only mean that this date is not a holiday.

The political consequences that such a decision by the BiH Constitutional Court would cause would be much more devastating for the narrative that politicians from Republika Srpska have been "pushing" for 23 years, and on the basis of which they draw their story about the declaration of independence and secession.

Thus, in the smaller BiH entity, politicians would no longer be able to triumphantly wave that RS was created in January 1992, i.e., before the world recognized BiH as an independent and sovereign state, and persistently claim that this administrative territorial unit has the prerogatives of a state.

There will be no more false constructions that RS was created in October 1991 by the will of the Serb people and Serb deputies in the Assembly of the then SR BiH, and officially proclaimed on January 9, 1992, thus before the aggression.

 There will no longer be room for stories from politicians from the smaller BiH entity that, as they like to say, the state of BiH did not exist until Dayton, when it was allegedly given legitimacy, and that RS only received international recognition.

If Izetbegović's appeal is accepted, Republika Srpska will be reduced to the Dayton framework, which will finally be confirmed by the highest judicial instance in the country that it was created at the end of 1995.

And that things are moving in that direction is confirmed by the preparation of the ground in the smaller BiH entity – the Declaration on the occasion of the request for an assessment of the constitutionality of the Law on Holidays of RS before the Constitutional Court of BiH, which will be on the agenda of the National Assembly of RS tomorrow, and the SNSD's resolution on the independence of RS, the adoption of which is planned for April 25 at the party's Congress.

By adopting this declaration, the deputies of the NSRS will preemptively announce tomorrow in Banja Luka that they will not respect the decision of the Constitutional Court of BiH.

This would be the 90th decision of the highest judicial instance in the country that is not respected and implemented, which is a criminal offense punishable by imprisonment.

Nevertheless, whether they agree to implement it now or not, it will be a historic decision of the Constitutional Court of BiH that will change many things in this country in the future.
