
(Patria) - Member of the Main Board of the Party for BiH and head of the party's caucus in the KS Assembly, Muamer Bandić, sent an open letter to High Representative Christian Schmidt.
We are publishing the letter in its entirety, without editorial intervention:
"Open letter to High Representative Christian Schmidt
Your Excellency,
I am addressing you at a time of continuous attacks on returnees in the RS entity and when anti-state elements are trying to turn the administrative line into a border.
I am addressing you in this way because there has been a lack of any legal sanction for those forces that are trying to destabilize this country and the region. You know well that the institutions of Bosnia and Herzegovina do not have the power to react because anti-state elements sit in them, and therefore I ask you publicly: When will you stop closing your eyes to Dodik's and Čović's targeted creation of political crises, with which they are trying to extinguish the state of Bosnia and Herzegovina with small but sure steps?
The goal of your mission in our country is to "ensure that Bosnia and Herzegovina is a country where peace will prevail" and "a sustainable country on the path to integration into Europe", and your tasks are:
1. Establish the rule of law;
2. Ensure that extreme nationalists, war criminals, and organized crime networks cannot stop the implementation of peace;
3. Implement economic reform;
4. Strengthen the capacities of BiH authorities, especially at the state level;
5. Establish civilian command and control over the armed forces at the state level, reform the security sector, and chart a path for integration into Euro-Atlantic structures;
6. Promote the sustainable return of refugees and displaced persons.
I hope that those who pay you, and register it as aid to Bosnia and Herzegovina, are monitoring the fulfillment of the goal and tasks, because you, through your actions, are doing everything to prevent the goal and tasks from being fulfilled, and with every move you make, especially by not sanctioning anti-state actions, you are hindering Bosnia and Herzegovina from becoming a modern, democratic, and European state.
Two years have passed since your arrival in Bosnia and Herzegovina, and the course of your mandate so far can be assessed with a Bosnian saying: "It's okay, as long as it doesn't shoot." For us who survived the aggression of a prepared and well-armed aggressor and genocide, this may be a realistic and reasonable life goal, but you are paid very well here and have all the necessary tools to achieve the goals and tasks of the OHR.
The hallmark of your mandate is that, by tacit consent and inaction, you leave political space for anti-state, secessionist forces to continuously question peace and stability in this country. This is done through various blockades, illegal and anti-state actions, support for and glorification of war criminals and their sick goals, blocking any economic progress and integration, targeted weakening of BiH institutions, and continuous attacks on returnees in the RS entity for whom, as a rule, perpetrators are never found, and even when they are, just punishments elude them.
Your Excellency,
I believe there is no person or domestic or international instance that does not understand that the BiH entity RS is a territory of RBiH forcibly occupied during the aggression against RBiH, which was completely cleansed of non-Serb population through genocide and ethnic cleansing.
It is widely known that the institutions of that BiH entity have been completely taken over by Greater Serbian politics, while other ethnic groups exist only as mere decoration.
The complete dominance over institutions by followers of Greater Serbian politics enables them to systematically disenfranchise Bosniaks, Croats, and Other citizens through the mechanisms of power. It is clear to everyone that today in that part of Bosnia and Herzegovina there is complete political, judicial, and media darkness, and all political parties of that BiH entity have formed governments based on the same aggressive and obscurantist model of mono-ethnic political rule. In such conditions, primarily through the abuse of entity voting, they continuously block the work of BiH institutions, legislative, executive, and judicial, producing political and legal anarchy in order to present Bosnia and Herzegovina as unstable and dysfunctional, and ultimately an unsustainable and impossible state.
You, as a rule, do not react to such destructive actions by Milorad Dodik and SNSD representatives, or you relativize them. That is why today we live in a country where attacks on returnees are an almost daily, normalized occurrence, and anti-state actions, crime, and corruption are the rule. Your tolerance and relativization of the glorification of open fascism and denial of genocide have opened up social space for such phenomena to become an integral part of the political folklore in this unfortunate country.
Your attitude towards the destructive actions of Dragan Čović and HDZ is also regrettable. I will remind you that from the 2018 elections until the beginning of this year, the Federation of BiH was completely blocked because Dragan Čović and HDZ blocked that process with their political blackmail. That anti-democratic episode ended with your interventions in the electoral process that was underway, and when even that was not enough to install a suitable government tailored to Dragan Čović and HDZ, then followed your temporary suspension of the Constitution of the FBiH, which represents a gross, bullying blow to the constitutional and legal order of the Federation of BiH, thereby rewarding Čović for years of complete blockade of the FBiH.
Yes, Mr. Schmidt, whether you like to hear this or not, you are the person who used the powers you have, not to fulfill the goals and tasks of the OHR mission in BiH, but to satisfy the goals of anti-state and secessionist policy that was convicted for the Joint Criminal Enterprise before the International Criminal Tribunal for the former Yugoslavia (ICTY).
Today, I can say with certainty that the Dayton Peace Agreement merely legalized the results of the war, and legitimized aggression, genocide, ethnic cleansing, and monstrous crimes as tools for achieving political goals. The goals of aggression and fascist policies have been fully achieved where fascist ideologies with their narrative have taken over institutions, completely permeated society, and shaped reality according to themselves. The only losers of the war and these 28 years of "cold peace" are pro-Bosnian political forces, i.e., all those who fought, both in war and in peace, for civilizational, European values and for Bosnia and Herzegovina as a normal, European state. I can say with certainty that the aggression against the Republic of Bosnia and Herzegovina and the attitude of the international community or the political West towards that aggression, and finally the Dayton model of ending such a barbaric and aggressive war on the backs of its victims, served as a beacon for the Russian Federation in its brutal aggression against Ukraine, which continues to this day. And believe me, Russia today hopes for the same solution to end the war for Ukraine..
Your Excellency,
the transition of our country from the Dayton to the European phase is not possible without punishing anti-civilizational and anti-European ideas, goals, and actions in our society, and the situation where openly anti-state elements rule the system institutions, which should carry out that transition, makes such a transition impossible. We can talk about the European path of Bosnia and Herzegovina, but that story is just "window dressing" and deceiving the public as long as our politics are managed by people who cherish anti-civilizational and anti-state ideas and policies. No matter how much individuals lie, Bosnia and Herzegovina will not be led into the European Union by the European Wine Law or amendments to the Law on the HJPC, which are not harmonized with European requirements and in which Article 26 literally states:
"Within one year of the entry into force of this law, the Parliamentary Assembly of Bosnia and Herzegovina shall adopt the Law on the High Judicial and Prosecutorial Council, which shall be harmonized with EU standards, as provided for in the European Commission's Opinion on Bosnia and Herzegovina's application for membership in the European Union."
Based on our historical and legal experience of living in the Dayton "cold peace", I can immediately say that we will never see a new Law on the HJPC harmonized with European standards, just as we have not seen any changes to the Dayton Peace Agreement in these 28 years. Moreover, we have not seen its full implementation, except for the military part of the agreement.
The policy of the international community in Bosnia and Herzegovina over the last 28 years, which you faithfully follow, is a brutal realpolitik of appeasing the most insolent and aggressive actors in political processes through continuous pressure on the weakest and those who have no choice, because they have no reserve homeland and who always give in in the end, driven by the illusion that compromise will bring us improvement. However, in reality, compromise only means a more aggressive campaign for new concessions to criminals and open fascists. Only in this context can your brutal suspension of the Constitution of the FBiH be properly understood, in order to bring subservient Bosniaks into the coalition, ready for all sorts of compromises to remain in power. And only in this context can your silence on vote-buying and political trading in the Sarajevo Canton Assembly and the House of Representatives of the FBiH Parliament be understood.
The compromise you are preparing us for with this hollow talk about some European laws, i.e., a new series of concessions to fascists, is the BiH Constitutional Court tailored to HDZ and SNSD, amendments to the BiH Election Law according to HDZ's wishes, and the resolution of the state property issue according to SNSD's wishes. You can only hope that your political protégés have bought enough votes to deliver these gifts to their real political masters and that you will not have to embarrass yourself again by making concessions to official Zagreb, as you did when you had to suspend the Constitution of the FBiH for 24 hours to form an imposed government of the FBiH that would serve as HDZ's pawn in this game of breaking Bosnian statehood.
What we, who love this country and have no reserve, certainly know is that once a signature is put on any form of appeasement of fascist ideas and goals, there is no moving forward or backward. Every compromise so far has meant for us a loss of sovereignty, a loss of statehood, and a greater degree of realization of the war goals of anti-state policies, i.e., their legalization and distancing from the European Union. It is nonsensical to even discuss something called state property because the term itself speaks of its content. Even those who try to alienate and steal it call it that, which raises the level of quasi-political madness to a new level of deception.
As for "legitimate representation" and counting fictional bloodlines, the latest ruling of the European Court of Human Rights has only confirmed what we all already knew, and that is that Bosnia and Herzegovina will never join the European Union as long as we engage in such retrograde, anti-civilizational, and essentially anti-European concepts.
What has personally disappointed me the most as a person is that you, who come from a European country that Bosnians and Herzegovinians respect and see as a role model, are giving space to such backward political narratives in the public space of Bosnia and Herzegovina. Just imagine the situation where, learning from the work of a German in Bosnia and Herzegovina, in a few years a million Turks in Berlin demand "legitimate representation"? You do not understand that by your actions in Bosnia and Herzegovina, you are not only destroying Bosnia and Herzegovina, but you are laying the foundations for the destruction of the European Union, by supporting legal principles and politics here that are contrary to European values, the same ones that Europe defeated on May 9, 1945."
