Agency for Civil Service of FBiH on the Competition of the Ministry of Transport of Canton Sarajevo

The Agency for Civil Service of FBiH reacted to the text of the Patria news agency regarding employment in the Cantonal Ministry of Transport, and we transmit the reaction in full.

- The content of the published text under the title: "Employment in the civil service - Director Maslo also involved. Job position in the Ministry of Transport tailored for Edin Išerić" contains untrue information and assumptions that do not reflect the standards of professional and objective journalism and as such are not in accordance with the Code of Press and Online Media in BiH.

The published content tendentiously and without arguments claims that the director of the Agency for Civil Service of the Federation of BiH was involved in the so-called tailoring of a job position for E. I., one of the candidates in the announced competition at the Cantonal Ministry of Transport, and that Director Maslo does not want to cancel, as claimed, an illegal competition even though the conditions of the competition for the position of civil servant associate for information did not require a graduate journalist, but only for candidates who have completed a law faculty or a faculty of public administration.

For the objective information of the public, we point out that the conditions for the admission of civil servants and employees are prescribed, in accordance with the law, by the civil service body, in this specific case the Cantonal Ministry of Transport, through the Rulebook on Internal Organization and Job Classification, to which the Government of the Canton gives consent after previously obtaining opinions from the Ministry of Justice and the Office for Legislation. The Agency for Civil Service is obliged to publish in the text of the competition strictly those conditions that are prescribed by the aforementioned Rulebook and has no influence on the possibility of amending or supplementing them. Therefore, the address for the mentioned objections is not the Agency but the Cantonal Ministry of Transport and the Government of Canton Sarajevo and the competent administrative inspection.
The second claim is incorrect, that the Director of the Agency cancels competitions at his own discretion, and not according to the law. The Agency for Civil Service has no legal authority to cancel a published competition without prior intervention of the competent body, the administrative inspection, or the Civil Service Board for Appeals or the competent court. The claim that the Director of the Agency arbitrarily canceled any competition, including the competition at the Federal Ministry of Labor and Social Policy, is also incorrect and arbitrary. The truth is that, while resolving a complaint-appeal from one of the candidates in the competition procedure, one action in the procedure was canceled - the results of the held written part of the professional exam, due to the improper work of the Candidate Selection Commission, with the competition not being canceled as arbitrarily claimed, and the procedure on the filed appeals is ongoing before the Civil Service Board for Appeals of FBiH.

It is true that for March 27 of this year, it was planned that the Selection Commission would hold a professional exam for the mentioned position. It is important to clarify that the members of the commission are not employees of the Agency and the Director has no influence on their work and the compilation of the List of Successful Candidates, which the Agency submits to the Cantonal Minister of Transport, who is the only one authorized to select a candidate from the List and appoint him to the specific job position. Therefore, once again, the only correct address is the Cantonal Ministry of Transport, i.e., the cantonal minister, and not the Agency for Civil Service or its director.
