Why Mektić must go to the Prosecutor's Office for his statement about a broken state, while Dodik doesn't

As things stand, the Minister of Security of Bosnia and Herzegovina, Dragan Mektić, will have to give a statement to the Prosecutor's Office because he called BiH a broken state, and the state prosecutor's office a hopeless case.

The offended, humiliated, state-building Chief Prosecutor of the BiH Prosecutor's Office, Gordana Tadić, stated at an extraordinary press conference that Mektić will have to explain to the BiH Prosecutor's Office "why BiH is broken". 

"The pressure exerted on the work of the Prosecutor's Office is inappropriate, and I will inform the HJPC, the Presidency of BiH about it. I believe that such statements undermine the constitutional order of Bosnia and Herzegovina."

The prosecutor did not reveal under which law the Prosecutor's Office would charge Mektić. However, even a cursory review of the Criminal Code of Bosnia and Herzegovina can reveal articles that warn of the punishability of an 'Attack on the constitutional order' of Bosnia and Herzegovina. No one has the right to dismantle what Prosecutor Tadić has been assembling for almost a year.

There is no doubt that an attack on the constitutional order of the country is dangerous. But the arbitrary application of justice is no less malignant.

It should be known that the Prosecutor's Office has never reacted to similar attacks on the state's constitutional order before. For example, the president of the BiH entity Republika Srpska, Milorad Dodik, very often states in his addresses that Bosnia and Herzegovina is broken. The most frequently mentioned statements by Dodik in public addresses in the last 11 months, since Tadić has been the head of the Prosecutor's Office, are: "BiH is a failed country" and "Bosnia and Herzegovina will never be a state." Unfortunately, Tadić did not hear Dodik's shots.

The confrontation between the Prosecutor's Office of Bosnia and Herzegovina and Minister Mektić may have a deep political background, agreed upon between the SNSD president Milorad Dodik and the HDZ BiH president Dragan Čović. The relations between the leaders of these two parties are obvious, publicly announced, and in no way hidden. What suits Dodik, Čović agrees with. And vice versa. Therefore, it is entirely legitimate to suspect that Dodik, with Čović's help, will use the state prosecutor Tadić in a showdown with his political opponent Mektić. Dodik's opinion of Mektić has been clear for a long time. He called the BiH Minister of Security a traitor and a Bosnian political clown after Mektić made claims in the media about Dodik's multi-million dollar crime.

Retired general of the Croatian Defence Council (HVO) and former president of the Federation of BiH, Živko Budimir, has been warning for some time that Tadić came to the position of Chief Prosecutor with the help of HDZ BiH.

"The Deputy Minister of Security of BiH, Mijo Krešić, is a high-ranking official of HDZ BiH and HNS. At his suggestion, Gordana Tadić was proposed for the head of the War Crimes Department at the BiH Prosecutor's Office, and now she is the acting Chief Prosecutor of the BiH Prosecutor's Office. Krešić and Tadić are related," Budimir revealed.
