(Patria) - Member of the Presidency of Bosnia and Herzegovina, Željko Komšić, filed a request with the Constitutional Court of Bosnia and Herzegovina for an assessment of the constitutionality of the Law on immovable property used for the functioning of public authorities of the BiH entity Republika Srpska, with a request for a temporary measure, to prevent irreparable damage from the eventual application of the disputed law.
"Regardless of the fact that requests for temporary measures are considered at plenary sessions of the Constitutional Court of Bosnia and Herzegovina, which are convened only a few times a year, we believe that the Constitutional Court of Bosnia and Herzegovina will recognize the importance and urgency of this matter and consider and decide on it as soon as possible.
The intention of officials from the executive authorities and administrative bodies in the BiH entity Republika Srpska to disrespect the decisions of the Constitutional Court of Bosnia and Herzegovina, and through proposing a slightly amended text and content of the disputed law which was previously annulled by the decisions of the Constitutional Court of Bosnia and Herzegovina, is a mockery of the rule of law in Bosnia and Herzegovina, which is unacceptable.
Therefore, we call on the competent Prosecutor's Office of Bosnia and Herzegovina to undertake all actions within its scope and in accordance with the Criminal Code of Bosnia and Herzegovina against persons who commit the criminal offense of non-execution of final decisions of the Constitutional Court of Bosnia and Herzegovina, as well as against persons who incite others to commit the aforementioned criminal offense, which falls under individual criminal responsibility, and not under any form of collective responsibility.
The manner in which the disputed Law on immovable property used for the functioning of public authorities of the BiH entity Republika Srpska was adopted clearly indicates the intention to commit such a criminal offense by officials from the executive authorities and administrative bodies in the BiH entity Republika Srpska, and therefore we expect a reaction from the competent prosecutor's office," it was stated from the Cabinet of Željko Komšić.
