It is worrying that the five accused of organized crime are free

Regarding the release of five accused individuals, as members of an organized group charged with the criminal offense of unauthorized production, possession, and sale of narcotic drugs, for the purpose of objectively informing the public, the Cantonal Prosecutor's Office of Sarajevo has issued a press release which the Patria News Agency transmits in its entirety.

By the decision of the Supreme Court of the Federation of Bosnia and Herzegovina, Eldar Zeba, Esad Babić, Saudin Vejzović, Enis Ćosić, Elvedin Halak, and Jasmin Oruč were released yesterday.

The Cantonal Prosecutor's Office of Sarajevo Canton filed an indictment on August 18, 2015, against the accused E.Z. (and five other persons), who is charged with organizing a group of five persons from October 29, 2014, to March 25, 2015, in the area of Sarajevo Canton, as well as in the area of Herzegovina-Neretva Canton (HNK) Mostar, who became members of an organized group for the purpose of unauthorized production, possession, and sale of narcotic drugs at various locations in the city of Sarajevo, as well as in the area of HNK Mostar.

All five accused, both as members of the group and E.Z. as the organizer of the group, have been released. The accused, who have been in custody since March of this year, were released by the decision of the Supreme Court of FBiH, and we inform the public that such a decision is a direct consequence of the fact that all previously made detention orders of the Cantonal Court in Sarajevo were revoked starting from August 21, 2015, and detention could only last until October 21, 2015.

At the same time, we deny the information from lawyer Omar Mehmedbašić that the appeal was granted because the accused did not act as an organized group, which is not true.

Namely, according to the decision of the Supreme Court, all decisions of the Cantonal Court in Sarajevo were always revoked for the same reason, because that court did not provide reasons in its detention decisions regarding decisive facts and committed a significant violation of the criminal procedure provisions each time, which it never rectified.

All of this, which is worrying, has resulted in all the accused in such a complex case being free since yesterday, according to the Prosecutor's Office statement.
