Council of Ministers of BiH must submit expenditure of funds collected from tolls on oil and oil derivatives

SARAJEVO, (Patria) – The House of Representatives of the Parliamentary Assembly of BiH adopted the Proposal for a Law on Amendments to the Law on Misdemeanors, proposed by the Council of Ministers of BiH, the Proposal for a Law on Amendments to the Law on Court Fees in Proceedings before the Court of Bosnia and Herzegovina.

Regarding the Proposal for a Law on Public Procurement of Bosnia and Herzegovina, proposed by the DF Club, a vote was taken on the opinion of the Constitutional and Legal Commission, whose opinion was not accepted, and the CLC is tasked with drafting a new opinion.

The Report of the Joint Committee of both houses of the Parliamentary Assembly of BiH on achieving an identical text of the Law on Amendments to the Law on Salaries and Allowances in Institutions of Bosnia and Herzegovina was also adopted, as well as the report of the Committee of the Collegium on efforts to reach an agreement on the Proposal for a Law on Amendments to the Law on Salaries and Other Allowances in Judicial and Prosecutorial Institutions of Bosnia and Herzegovina.

The report of the Committee of the Collegium on efforts to reach an agreement on the Proposal for a Law on Prevention of Conflict of Interest in Institutions of BiH, proposed by representatives Saša Magazinović, Damir Arnaut and Jasmin Emrić, was adopted.

The Report of the Committee of the Collegium on efforts to reach an agreement on the representative initiative of the SDA Club representatives was also adopted, which reads: „Based on Article 8 of the Rules of Procedure of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina, we submit a representative initiative by which the House of Representatives of the Parliamentary Assembly of BiH, in accordance with Article 35 of the Law on the Council of Ministers of Bosnia and Herzegovina (“Official Gazette of BiH”, no. 30/03, 42/03, 81/06, 76/07, 81/07, 94/07 and 24/08), obliges the Council of Ministers of BiH to prepare, within 90 days, a Proposal for a Law on Amendments to the Law on Judicial Police of Bosnia and Herzegovina (“Official Gazette of BiH”, no. 3/03, 21/03 and 8/13), in such a way that the Judicial Police of Bosnia and Herzegovina is established as a basic organizational unit within the Court of Bosnia and Herzegovina.

In the second round of voting, the Report of the Council of Ministers for 2019 was adopted, but with two conclusions: to determine a new methodology for presenting the report that would be adapted to the debate in the houses of the Parliamentary Assembly.

A conclusion by Jasmin Emrić was also adopted, requiring the Council of Ministers to submit the expenditure of funds collected from tolls on oil and oil derivatives and a financial overview by year from 2017 to 2019 by project.

The representatives did not adopt the Report on the Financial Operations of BHRT for 2019, while the Program Plans and Financial Plan of BHRT for 2020 were taken note of.

A conclusion was adopted tasking BHRT to submit, within 30 days, a plan for repaying the debt to the European Broadcasting Union and submit it to the Parliamentary Assembly as an integral part of the financial report.

A proposal was also adopted for the Council of Ministers of BiH, together with the entities, to propose a new Law on the Public Broadcasting Service, which would regulate the collection of fees, relations among broadcasters, and the distribution of collected fees.

The Special Report on the representation of constituent peoples and others in institutions, administrative organizations and regulatory bodies of Bosnia and Herzegovina, the Republika Srpska, the Federation of Bosnia and Herzegovina, the Brčko District of Bosnia and Herzegovina and the cantons of the Federation of Bosnia and Herzegovina, with the exception of police and security structures, submitted by the Institution of the Ombudsman for Human Rights of BiH, was also adopted.

Three conclusions were adopted concerning the implementation of the Ombudsman's recommendations by 2022 and that the Parliamentary Assembly of BiH be informed thereof.

The representative initiative of Saša Magazinović was also adopted, which reads: „Based on Article 8 of the Rules of Procedure of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (“Official Gazette of BiH”, no. 79/14, 81/15, 97/15, 78/19 and 26/20), I submit a representative initiative tasking the Collegium of the House of Representatives of the Parliamentary Assembly of BiH, in cooperation with the Council of Ministers of BiH, to prepare material and ensure the presence of competent members of the Council of Ministers of BiH for the next session of the House of Representatives of the Parliamentary Assembly of BiH, so that the House of Representatives can receive relevant information and then discuss the Opinion of the European Commission on Bosnia and Herzegovina's application for membership in the European Union, with special emphasis on the implementation of the 14 key priorities from this document”.

The Proposal for a Conclusion by representatives Aida Baručija, Branislav Borenović, Dženan Đonlagić, Edita Đapo, Jasmin Emrić, Mirjana Marinković-Lepić, Saša Magazinović and Šemsudin Mehmedović was adopted, which reads: „The Council of Ministers of BiH is tasked with submitting to the House of Representatives of the Parliamentary Assembly of BiH for consideration information on the situation in the area of migration in Bosnia and Herzegovina for the period January – August 2020, and that it be considered in the presence of the heads of all competent bodies and institutions for migration and asylum in Bosnia and Herzegovina”.

Consent was also given to three loan agreements between the Council of Ministers of Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury of BiH, and the Government of the Swiss Confederation, represented by the State Secretariat for Economic Affairs (SECO), regarding the approval of a financial contribution in the form of a donation for the Wastewater Collection and Treatment Project in Gradiška, Bosnia and Herzegovina, and the European Bank for Reconstruction and Development between Bosnia and Herzegovina and the International Bank for Reconstruction and Development.
