Constitutional Court rules on Han Pijesak: BiH one step closer to NATO

The RS Attorney General's Office filed an appeal with the BiH Constitutional Court in September 2016, requesting a stay of execution of the BiH Court of Appeals decision ordering that military property in Han Pijesak (Veliki Žep facility) be registered to BiH, writes the Patria News Agency.

The RS, it was stated, will seek to block the execution of the court decision until the request for a review of the proceedings in this case is adopted. The Constitutional Court has just made a decision rejecting the appeal of the RS Attorney General's Office. This is the final point for the registration of not only the Veliki Žep facility in Han Pijesak, but, based on the principle of precedent law, it establishes the legal basis for the registration of all military property for the needs of the Armed Forces of BiH (so-called perspective property) and the last condition for the activation of the MAP on Bosnia and Herzegovina's path to NATO.  

As there are no formal legal obstacles to completing the registration of this property and executing the final and binding decisions of the BiH Court in this case, it is expected that the RS Geodetic Administration and responsible persons in the RS will immediately proceed with the execution of this decision. 

Obstruction and non-execution of the final decision of the Constitutional Court would be punishable under the Criminal Code of BiH, and therefore the BiH Prosecutor's Office is obliged to monitor the execution of these judgments. 

It is expected that the Supreme Commander of the Armed Forces, the BiH Presidency, will inform NATO Secretary General Jens Stoltenberg that the conditions for activating the MAP for BiH have been met. 

Finally, after almost nine years, the last condition has been met, and the state of BiH is entering the peaceful integration waters of the NATO family.
