Detention for Ahmed Kastrati, accused of murdering Saša Vilušić in Tuzla, lifted

(Patria) - The Supreme Court of FBiH has lifted the detention of the accused Ahmed Kastrati in the criminal case pending against him before the Cantonal Court in Tuzla for the crime of murder.

The Supreme Court of FBiH announced today that the legal deadline of two months, during which the detention could last according to the decision of the first-instance court, expired on February 9, without that decision becoming final.

Namely, at the time of deciding on the appeal of the accused's defense attorney against the decision of the first-instance court which extended the detention for another two months, i.e., until April 9, no decision was made on the decision of the Supreme Court of FBiH of February 2, which ordered the first-instance court to re-decide on the detention, which could have lasted until February 9.

At the time of the Supreme Court of FBiH's decision of February 23, there is no legal basis for further detention of the accused, which does not exclude the re-imposition of detention if the conditions for it exist, it is stated in the announcement.

On the other hand, the Cantonal Court in Tuzla announced that the Supreme Court of FBiH's decision granted the appeal of the accused's defense attorney and overturned the Cantonal Court in Tuzla's decision of February 9, which extended his detention for another two months.

"At the same time, it was decided that the detention of the accused is lifted and he is to be released immediately. Upon receipt of the said decision, the Cantonal Court in Tuzla issued an order to the competent Penitentiary Institution to release the accused immediately," the court announced.

Kastrati, we remind you, is accused of murdering Saša Vilušić, and the indictment refers to an event on June 21 last year in a catering facility in Tuzla, when, according to the prosecution, Kastrati inflicted injuries on Vilušić from which he died on July 10.

According to the indictment, Kastrati approached Vilušić from behind after his conflict with another person, pulled him by the shoulder and hit him with his fist in the eye, after which Vilušić lost consciousness, fell, and sustained fatal head and brain injuries.
