Victims' associations appeal: BiH Prosecutor's Office not applying 'Inzko's Law', let Federation and cantonal institutions do it

(Patria) - Milorad Dodik has once again denied the genocide in Srebrenica, which has been established by the judgments of the International Court of Justice (ICJ), the International Criminal Tribunal for the former Yugoslavia (ICTY), and the Court of BiH, warn the Association of Victims and Witnesses of Genocide and the Association of the Movement "Mothers of the Enclaves of Srebrenica and Žepa".

"It is obvious that the BiH Prosecutor's Office and state institutions are not applying 'Inzko's Law', and not only are they not applying it, but dozens of reports for denying genocide submitted by individuals and NGOs have been REJECTED by the BiH Prosecutor's Office. And after almost two years, the BiH Prosecutor's Office has not filed a single indictment for denying genocide.

Why BiH institutions are not applying and legally ignoring 'Inzko's Law' is a question for the High Representative, the HJPC and the disciplinary prosecutor, as well as representatives of the international community who are responsible for the reform of BiH's judiciary. In this regard, we call on the competent institutions of the Federation of BiH and the Cantons, the Ministries of Internal Affairs and the Prosecutor's Offices in the Federation of BiH, to URGENTLY and without fail initiate an investigation against Milorad Dodik, applying the Criminal Code of the Federation and Article 163 of Chapter XV CRIMINAL OFFENCES AGAINST THE CONSTITUTIONAL ORDER OF THE FEDERATION - Inciting national, racial and religious hatred, discord or intolerance;

"(1) Whoever publicly incites or spreads national, racial or religious hatred, discord or intolerance among the constituent peoples and others living in the Federation, shall be punished by imprisonment from three months to three years. Whoever commits the criminal offense from paragraph (1) of this Article by publicly denying or justifying genocide, crimes against humanity or committed war crimes established by a final decision of the International Court of Justice, the International Criminal Tribunal for the former Yugoslavia or a domestic court shall be punished by imprisonment from three months to three years," and in connection with Article 13 - Application of Criminal Legislation in the Federation for criminal offenses committed in the territory of Bosnia and Herzegovina

"(1) Criminal legislation in the Federation shall apply to anyone who commits on the territory of Bosnia and Herzegovina: any criminal offense against the constitutional order of the Federation from Chapter XV (Criminal Offenses against the Constitutional Order of the Federation) of this Law;"

We demand that the competent Federal and Cantonal institutions cooperate with the MUP and the Prosecutor's Office of Republika Srpska in order to prosecute Milorad Dodik, but also with State institutions in order to protect the Constitutional Order of the Federation and the state of BiH.

Also, we call on all interested parties and individuals who are commenting on the denial of genocide and other crimes against humanity, to обязательно emphasize that it is about denying judgments rendered by international and domestic courts, because in this way they narrow the space for deniers and support the Laws of BiH, which clearly define that the denial of the aforementioned judgments is a criminal offense, and not the denial of historical, scientific, historical, general legal or some state decisions or findings of commissions that do not represent the essence of the criminal offense of denial in accordance with the Laws of BiH and F/BiH," the statement said.
